Waste disposal licence compliance assessment
The Department of Environment, Food and Agriculture has introducing a compliance assessment scheme for the operation of waste disposal licences and directions issued respectfully in pursuance of sections 59 and 64 of the Public Health Act 1990.
The scheme is designed to promote effective supervision of licensed activities and to ensure:
- That the activities to which the licence relates do not cause pollution of water, danger to public health or become seriously detrimental to the amenities of the locality
and - Compliance with the conditions in the licence
The compliance assessment scheme for waste site inspections will help deliver DEFA's Enforcement Policy Statement in line with the principles for enforcement as follows:
I. Proportionate
Compliance assessments will ensure that DEFA resources are targeted towards activities where there is poor compliance. Compliance assessment results will inform DEFA's resourcing decisions.
II. Consistent, fair and legally correct
The compliance scheme aims to standardise assessment of licensed waste disposal activities. It provides a 'level playing field' due to consistent and fair assessments of each facility.
III. Transparent and accountable
Clearly structured and simple assessment sheets are used for each facility type and these are available to licence holders and the public. The compliance assessment will be shown to be as transparent and objective as possible.
IV. Targeted, efficient and effective
By consistently and transparently providing feedback on compliance issues to licence holders within a structured and formal framework, the scheme will help DEFA to deliver the desired environmental outcomes by working with licence holders. Public scrutiny of published compliance data is intended to encourage environmental improvement.

How we assess waste operations
The compliance assessment will consist of a site inspection which will review site operations against conditions listed in the Waste Disposal Licence and a site walk around. During the assessment all non-compliances will be recorded and the assessment report will indicate which conditions of the Waste Disposal Licence has been assessed and brief description of findings:

During the assessment if a non-compliance of a Waste Disposal Licence condition or any environmental impact during the site walk around is discovered an compliance scoring will be given to the non-compliance based on the impact or potential impact. Each non-compliance is scored separately and the score is dependence on the severity and impact of the non-conformity.

All the non-compliance scores will be totalled and an assessment outcome will be an overall ranking for the site, ranging from 'excellent' to 'very poor'. Future site compliance assessments will be undertaken on a schedule defined by the past compliance rating.
