Implementation Plans
The Department of Home Affairs (DHA) is currently responsible for the delivery to full operation, including any secondary legislation requirements, of the following Acts:
- Domestic Abuse Act 2020: the associated Implementation Plan 2022 was issued on the 24 March 2022, last updated May 2023
- The Domestic Abuse Multi-Agency Working Protocol 2023, as referenced on page 18 of the Implementation Plan, has now been published
- Justice Reform Act 2021: the associated Implementation Plan 2022 was issued on the 24 March 2022, last updated August 2022
- Sexual Offences and Obscene Publications Act 2021: the associated Implementation Plan 2022 was issued on the 24 March 2022, last updated May 2023
- Liquor Licensing and Public Entertainments Act 2021: the associated Implementation Plan 2022 was issued on the 24 March 2022, last updated August 2022
Please note any amendments made are highlighted in red, any deletions have been struck through, and commentary is included to provide reasoning for any changes.
These Implementation plans are 'living documents' and will be regularly updated to capture any progress commentary or additional information as these implementation projects are underway.
Current Existing Legislation
The Department of Home Affairs has wide ranging responsibilities which include maintaining the legislative basis on which the core functions of the Department operate, alongside legislating to provide for other aspects of the criminal justice system. The Department is also responsible for acting as the appropriate authority for the Police service, the Fire and Rescue Service and the Prison and Probation service. It provides oversight and assurance in relation to the operation of those functions. The primary areas of the Department’s responsibilities are set out below:
Core Service Areas
- Prison Service under the Custody Act 1995 along with establishment of the Independent Monitoring Board(s) and the Parole Committee, along with the associated Prisoner Escorts Act 2008
- Isle of Man Constabulary under the Police Act 1993 along with the Police Complaints Commissioner and associated Police Powers and Procedures Act 1998
- Probation Service under the Criminal Justice Act 1963
- Fire and Rescue Service under the Fire Service Act 1984 and associated Fire Precautions Act 1975
- Communications Technical Division under the Fire Services Act 1984 and the Police Act 1993
- Emergency Planning / Civil Defence under the Civil Defence Act 1954 and the Home Affairs Board Act 1981

Acts including the following under which the Department has legislative powers or statutory obligations:
- The Criminal Justice Act(s) 1953 – 2001
- Criminal Procedure and Investigations Act 2016
- International Criminal Court Act 2003
- Rehabilitation of Offenders Act 2001
- Criminal Evidence Act 2019

Other core functions

- Financial Intelligence Unit Act 2016 and the Financial Intelligence Unit established under that Act
- Firearms Act 1947 and Shot Guns, Air Weapons and Cross-bows Act 1994 which links to licensing and enforcement
- Fireworks Act 2004 which links to Fireworks display notifications
- Regulation of Surveillance Etc Act 2006 including the appointment of the Regulation of Surveillance Commissioner
