Introduction

In these terms and conditions ‘we’ and ‘us’ mean the Isle of Man Government.  References to the Isle of Man Government in the these terms and conditions include, where appropriate, references to any Department or Statutory Board (as defined in the Interpretation Act 1976) and to any person or body holding office under the Crown in right of the Isle of Man.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Isle of Man. Any dispute arising under these Terms and Conditions of use shall be subject to the exclusive jurisdiction of the Isle of Man Courts.

In interpreting these Terms and Conditions of use:

  • The use of the singular includes the plural and the use of the plural indicates the singular
  • It is not intended that the headings should be taken into account and
  • An Associated Business means a business assisting the Isle of Man Government in the provision of goods or services for which the government is responsible

Online Government services or transactions

When using gov.im you may access an online Government service or transaction that is delivered by another government department or agency. Each of these services will have its own terms and conditions or end user licences that apply to that service only. Users of any online service should make sure they have read the relevant terms and conditions before completing that transaction.

Gov.im is a website managed on behalf of the Isle of Man Government by the Chief Secretary's Office/Cabinet Office (CSO/CO). The CSO/CO will seek to ensure that the information published on the Isle of Man Government website is accurate and up-to-date. Any personal information collected through this website will be treated as confidential in line with the principles of the Data Protection Act 2002.

Cookies and website traffic analysis

When users enter the Isle of Man Government website their computers will automatically be issued with 'cookies'. Cookies are text files which identify users’ computers to the Isle of Man Government server. The website then creates 'session' cookies that store some of the preferences of users moving around the website, for example retaining a text-only preference. Cookies in themselves do not identify individual users but identify on the computer used and they are deleted on departure from the website.

The Isle of Man Government website uses third party cookies to measure the website including the number of visitors and how frequently pages are viewed.  This helps to determine what is popular and can influence future content and development. For this purpose, the Government uses Google Analytics to measure and analyse usage of the website. The information collected by the Isle of Man Government will include IP addresses, pages visited, browser types and operating systems. The data will not be used to identify any user personally.

Log files

Log files stored on the Government’s web server allow the recording and analysis of users’ use of the website. Log files do not contain any personal data.

Collection and use of personal data

The site is owned by the Isle of Man Government and co-ordinated by the Chief Secretary's Office/Cabinet Office.

A user does not have to register to use the Isle of Man Government website, but a user must register if they wish to receive, daily, weekly or monthly news, information and updates about the Government via email and mobile.

Before your provide information to the Isle of Man Government about a third party you must obtain the correct authority of the individual concerned and undertake to keep that individual advised about how that individuals information will be used.

The information is stored securely on our database until such time as a user chooses to unsubscribe from receiving information or other updates and may opt-out of receiving these communications by clicking the unsubscribe options on any email communication received or the user may contact us to opt-out at the address below.

Surveys

From time to time, our site requests information from users via surveys or contests. Participation in these surveys or contests is completely voluntary and the user has a choice whether or not to disclose their information. Contact information will not be shared with any third parties unless we give prior notice or choice. Though we may use an intermediary to conduct these surveys or contests, they may not use users’ personally identifiable information for any secondary purposes.

Where possible we will provide you with access to the information we hold about you so that you can review this information and provide a way for you to have this information changed if it is not correct.

Alternatively you can ask for information we hold about you by sending your request to the Cabinet Office Data Protection Officer.

Information sharing

Though we make every effort to preserve user privacy, we may need to disclose personal information where, in good faith we believe such action is necessary and required by law to comply with legal proceedings, a court order or legal process. 

Where it is lawful to do so, we may share personal data that you provide to Isle of Man Government and to associated businesses. All information provided may be monitored for quality assurance and security purposes.

The Website contains links to other sites. Please be aware that the Isle of Man Government are not responsible for the privacy practices of such other sites. Visitors to our site should be aware when they leave our site to read the privacy statements of each and every website that collects personally identifiable information as this Privacy Statement solely applies to information collected by this website.

Third party intermediaries

We use an external contractor to manage our user database that does not retain, share, store or user personally identifiable information for any secondary purpose.

Service providers

We partner with other third parties to provide specific services.  For example database development, push mobile technology and hosting.  When the user signs up for these particular services, we share names, or other contact information including mobile number and full contact information with the third party service providers so that the third party can supply these services.  These third parties are not allowed to user personally identifiable information except for the purposes of providing these services.

Users of our site are always notified when their information is collected by any outside parties.  We do this so our users can make an informed choice as to whether or not they should proceed with services that require an outside party.

Notification of changes

The Isle of Man Government reserves the right to alter the content, presentation, performance, user facilities and availability of all or any part of the site at its sole discretion, at any time, and without giving notice.

Any goods or services indicated as being available on the site may with withdrawn or modified at any time.  Any information on this site regarding goods or services that are provided by the Isle of Man Government is not intended to change the manner in which those goods or services must be supplied or the entitlement to those goods or services as provided for in law.

Consultations

All consultation papers are available for viewing on the Isle of Man Government consultation website. When a consultation exercise is completed, consultation responses are also available for viewing on the Isle of Man Government consultation website.
