Export Control (Amendment) Order 2019 (Application) Order 2019

The Treasury advises that the above Order has been approved by Tynwald and makes amendments to existing export control legislation in the Island.

The Export Control (Amendment) Order 2019 which is being applied in Island law with modifications, amends the Export Control Order 2008, as it has effect in the Island (“the ECO”), to update those Articles in the ECO concerning trade in certain goods which could be used for capital punishment, torture or other cruel, inhuman or degrading treatment or punishment, following the replacement of Council Regulation (EC) No 1236/2005 of 27 June 2005 (as amended) with reference to Regulation (EU) 2019/125 of the European Parliament and of the Council.

Schedule 2 to the ECO (which lists the military goods, software and technology subject to export controls) is amended by the applied Order to implement changes to the European Union Common Military List as required by Commission Directive (EU) 2019/514 of 14 March 2019 that in turn amends the Annex to Directive 2009/43/EC that simplifies the terms and conditions of transfers within the European Union of defence-related products.

The applied Order also amends Schedule 4 to the ECO to remove Eritrea from the list of countries and destinations that are embargoed and subject to transit control for military goods. This follows the lifting of sanctions against Eritrea by the United Nations and the European Union.
