Export Control (Sanctions) (Amendment) Order 2019 (Application) (No.2) Order 2019
The Treasury advises that the above Order comes into operation on 1 January 2020 and makes amendments to existing export control legislation in the Island.
The Export Control (Sanctions) (Amendment) Order 2019 which is being applied in Island law with modifications, amends the Export Control Order 2008 (“the ECO”), and a number of ancillary orders and regulations, as they have effect in the Island.
Eritrea is added to the list of destinations subject to transit controls for Category B goods in Part 4 of Schedule 4 to the ECO. “Category B goods” are certain military goods specified in Part 2 of Schedule 1 to the ECO.
The Export Control (Russia, Crimea and Sevastopol Sanctions) Order 2014 (“the 2014 Order”) is amended to update definitions of “the Russia Sanctions Regulation” and “the Crimea and Sevastopol Regulation”. Amendments also made to clarify the effect of other interpretative provisions in the 2014 Order.
A number of definitions in the Export Control (Sudan, South Sudan and Central African Republic Sanctions) Regulations 2014 are also updated. A new offence for the breach of the prohibition in the EU South Sudan Regulation relating to the provision of services of armed mercenary personnel in South Sudan is also created.
The Export Control (Venezuela Sanctions) Order 2018 has been amended to create a new offence of failing to comply with a condition included in an authorisation granted under the Venezuelan Sanctions Regulation and to create a penalty for that offence. It also makes clear that the maximum term of imprisonment that may be imposed is 3 months.
The Export Control (North Korea Sanctions) Order 2018 (“the North Korea Order”), is amended to create new offences for, or in connection with, contravention of trade restrictions which have been added to the North Korea Regulation, since the North Korea Order was made and penalties for those offences.
The Export Control (Burma Sanctions) (No.2) Order 2018 has been amended to correct a cross- referencing error.
