European Union (Libya Sanctions) (Application) (Amendment) Order 2018 and Libya Sanctions (Amendment) Regulations 2018
The European Union (Libya Sanctions) (Application) (Amendment) Order 2018 and Libya Sanctions (Amendment) Regulations 2018 came into operation on 20 December 2018.
This Order applies Council Regulation (EU) 2018/2004 of 17 December 2018, amending Council Regulation (EU) 2016/44 concerning restrictive measures in view of the situation in Libya, as part of the law of the Island, subject to certain modifications.
Council Regulation (EU) 2018/2004 substitutes Article 6(1) of Regulation (EU) 2016/44 to update the list of United Nations Security Council Resolutions ("UNSCR") following the adoption of UNSCR 2441 (2018). This latest Resolution condemns attempts to illicitly export petroleum, including crude oil and refined petroleum products, from Libya. The Resolution extends the designation criteria which are used to determine who should be subject to an asset freeze or travel ban.
The Libya Sanctions (Amendment) Regulations 2018 make corresponding changes to the Libya Sanctions Regulations 2016, which established offences and penalties for breaches of Council Regulation (EU) No 2016/44.
