Export Control (Libya Sanctions) Order 2016 (Application) Order 2016

The Treasury announces that the above Order has been made and will come into operation with effect from 12 August 2016, and wishes to bring to the attention of persons in the Island new offences and penalties involved.

The Export Control (Libya Sanctions) Order 2016 (“the applied Order”), which is being applied in Island law with modifications, provides for the enforcement of the trade restrictions against Libya specified in Council Regulation (EU) No 2016/44, and creates the necessary offences and penalties for contravention of those trade restrictions.

The penalties involved are custody for 6 months, a fine not exceeding £5,000, or both for conviction in summary proceedings, or custody for up to 10 years, a fine, or both for conviction on information.

The applied Order also provides for an offence of knowingly or recklessly providing false information for the purpose of obtaining an authorisation (licence), or for failing to comply with the requirements or conditions of such an authorisation.
