European Union Sanctions – Central African Republic and South Sudan

On 29 May 2015, two new Orders applied in the Island recent EU Council Regulations which amended the sanctions regimes relating to the Central African Republic and South Sudan.

The European Union (Central African Republic Sanctions) (Amendment) Order 2015 [SD 2015/201] applied in Island law Council Regulation (EU) No 2015/734 of 7 May 2015 which –

  • amended Council Regulation (EU) No 224/2014 to allow for a derogation for technical assistance, financing or financial assistance or brokering services relating to the support or equipment of UN, African Union and French forces deployed in the Republic; and
  • amended the criteria for the designation of persons and entities, as provided for in UN Security Council Resolution 2196 (2015).

At the same time the Central African Republic Sanctions (Amendment) Regulations 2015 [SD 2015/202] came into operation for the implementation of the Order and the Regulation 2015/734.

The European Union (South Sudan Sanctions) Order 2015 [SD 2015/199] applied in Island law Council Regulation (EU) No 2015/735 of 7 May 2015 which –

  • repealed and replaced Council Regulation (EU) No 748/2014, which inter alia, provided for the designation of those involved in obstructing the political process in, or violating human rights in, South Sudan; and
  • reflected UN Security Council Resolution 2206 (2015), which provides for restrictions involving those persons responsible for, complicit in, or having engaged in, directly or indirectly, actions or policies that threaten the peace, security or stability of South Sudan.

At the same time, the South Sudan Sanctions Regulations 2015 [SD 2015/200], concerned with the implementation of Regulation 2015/735, provided for offences and penalties for breaching the provisions of the Regulation, for the granting of derogations and licences etc, and for the obtaining and sharing of information by the Treasury.
