European Union Sanctions - Export Control

The Treasury has made the following Orders which provide for the enforcement in the Island of various trade restrictions imposed by means of European Union Regulations that have been applied in Island law.

The Export Control (Various Amendments) Order 2015 (Application) Order 2015 has effect from 24 February 2015 and provides for the enforcement of the extended trade sanctions in respect of Ukraine and the Crimea and Sevastopol, and new trade restrictions involving the sale etc of jet fuel and fuel additives involving Syria.  These changes take account of amendments to the existing sanctions regimes made by means of Council Regulations (EU) Nos. 1290/2014, 1351/2014 and 1323/2014.

The Export Control (Sudan, South Sudan and Central African Republic Sanctions) Regulations 2014 (Application) Order 2015 has effect from 1 March 2015 and  provides for the enforcement in the Island of trade restrictions against Sudan, South Sudan and the Central African Republic contained in various EU Council Regulations which have effect in the Island.  Details of the restrictions are contained in Council Regulations (EU) Nos 747/2014 (re Sudan), 748/2014 (re South Sudan) and 224/2014 (re the Central African Republic).

The amendments made by both Orders supplement existing customs legislation and provide for offences and penalties for contravention of certain provisions of the various Regulations, by any person in the Island or by any “Island person”.

An “Island person” is defined in article 2(1) of the Export Control Order 2008, as it has effect in the Island, as including British citizens, British subjects and British protected persons who are resident in the Island, as well as bodies incorporated under Island law and limited liability companies.
