Export and Trade Controls

Tuesday, 25 March 2014

The Treasury advises that the Export Control (Amendment) Order 2014 (Application) Order 2014 has effect from 9 April 2014.

This Order gives effect in Island law to Article 10 of the UN Arms Trade Treaty on brokering controls.  The list of items subject to trade controls in Part 2 of the Export Control Order 2008 is expanded to include all conventional arms falling within categories specified in the Treaty.

Trade controls are explained in Notice 279T, available on the Customs and Excise website.  In essence, the controls are on the activities of persons in the Island, and of Island persons and businesses, in the movement, sale or supply of certain goods between two overseas countries.

As well as military and paramilitary goods, the controls extend to such things as security and paramilitary police equipment (i.e. goods for internal repression or torture such as electric shock batons and belts, leg-irons etc), riot control substances and types of cluster munitions.
