Syria Sanctions - Export Control (Syria Sanctions) (Amendment) Order 2014 (Application) Order 2014 - Import, Export, Transfer of Syrian Cultural Property

The above Order, which comes into effect in the Island on 8 August 2014, creates new offences of breaching certain prohibitions connected to Syrian cultural property and contained in Council Regulation (EU) No 36/2012, as amended.

The prohibitions are concerned with the trade in certain Syrian cultural goods where there are reasonable grounds to suspect that the goods have been removed from Syria without the consent of the legitimate owner, or in breach of Syrian or international law.  The relevant goods are Syrian cultural property goods and other goods of archaeological, historical, cultural, rare scientific or religious importance, and include those listed in Annex XI to the Council Regulation, as amended.  The Council Regulation, as amended, prohibits the import, export, transfer, and the provision of brokering services related to the import, export or transfer of relevant cultural property.  The new Order is concerned with offences related to the transfer or the provision of brokering services – offences related to the import or export of such property are already available in the Customs and Excise Management Act 1986.

The new Order also increases the maximum penalty for importing or exporting relevant property to 10 years.
