Developer's caution against damage to birds

A Manx company has been given a formal caution following damage to nesting birds during development work. On removing a roof, sparrow nests (specially protected) were disturbed and lost. This resulted from a lack of checks prior to works and is deemed reckless behaviour. Advice is being provided and improved procedures are being developed with regard to bats and birds.

All owners, developers and contractors are reminded of the statutory wildlife protection provided under the Wildlife Act 1990. In order to avoid offences of reckless destruction or disturbance, adequate checks must be undertaken. Developers are requested to review their procedures in the light of this incident. If issues come to light as a result of site checks, the Department of Environment, Food and Agriculture can advise on how to proceed. Forward planning can avoid problems and delays later on

A similar situation arises with regard to building maintenance works. Owners and contractors are asked to consider these issues and the timing of their checks and works. Active bird nests are protected, but works may proceed once nesting is completed. If work is necessary during the main breeding period, then it may be necessary to prevent access by birds earlier in the season.

'It is unfortunate that cases like this still arise over 20 years after the Wildlife Act came into force but I am pleased that our enforcement officers are picking these up and dealing with them at an appropriate level. It is important that everyone is aware of the legal requirements. With suitable planning, there is no reason why this sort of case should arise. The Department is always happy to offer advice on the protection of wildlife, so there is really no excuse for work that does not take this into account.'
