Democratic people's Republic of Korea Ivory Coast

The Treasury advises that the Export Control (North Korea and Ivory Coast Sanctions and Syria Amendment) Order 2013 (Application) Order 2013 comes into operation with effect from 7 January 2014.

This will apply in Island law Export Control (North Korea and Ivory Coast Sanctions and Syria Amendment) Order 2013, as well as making necessary amendments of other orders, to update Isle of Man export control legislation in respect of North Korea and Ivory Coast.

The applied Order provides for the enforcement of Council Regulations 329/2007/EC and 174/2005/EC, replacing and consolidating in one instrument the penalties and offences relating to the enforcement of trade sanctions against the two countries.

There remain comprehensive restrictions on trade with North Korea, as well as other sanctions measures imposed by both the United Nations and the European Union, which include the freezing of assets.

Whilst trade restrictions against the Ivory Coast have been significantly reduced since July 2012, there remain in place certain measures, including a prohibition on the supply, transfer or export of equipment which might be used for internal repression.

One should note that many of the prohibitions and restrictions involving North Korea, the Ivory Coast and Syria include not just export embargoes, the freezing of assets and prohibition on making available economic resources, but also “trade controls” involving the trafficking or brokering in certain goods by someone in the island, or by an Island person outside the Island.

Due to the extreme weather, heavy rain and gales, the Department would like to notify the public that the front door to Ramsey and District Cottage Hospital has had to be closed, while repair work is carried out.

Please use the Martin Ward entrance to the hospital, situated on the left hand side of the second car park.

All services including the Minor Injuries and Illness Unit (MIU) are available as normal.

The Department of Health apologises for any inconvenience to patients. This is a necessary precaution to ensure the safety of patients and staff.

Proposed changes to local government audit and financial reporting

The Treasury is consulting on proposed changes to the financial regulatory framework for the Island’s local government bodies which are intended to adopt a more proportionate approach to managing the related risks across the sector.

There are over 50 local government bodies, including local authorities and combination bodies, ranging in size from annual gross expenditure of less than £5,000 to over £30,000,000. Under the Audit Act 2006 (and subsequent regulations) each of these bodies, regardless of size, is required to undergo a full statutory audit with a total current cost to the sector of over £210,000.

The Treasury, having noted the high level of financial compliance now being achieved across the sector, now considers that the existing ‘one size fits all’ approach is no longer appropriate and so is proposing a revised and more proportionate framework to audit/inspection, based upon turnover:

1.	£1m and above:	Full Statutory Audit.
2.	£100k to £1m:	Assurance Review by a regulated auditor.
3.	Under £100k:	Qualified Independent Examination

A similarly proportionate approach based upon the same turnover thresholds is also being proposed for the approach to, and format of the annual accounts required to be published by each body.

Commenting on the proposal, Minister for the Treasury, Hon. Eddie Teare MHK said:

‘The Treasury is pleased to now be in a position to make these proposals and anticipate that, if progressed, they should significantly reduce the overall regulatory burden whilst still maintaining a high standard of financial reporting across the sector.’

Chair of the Treasury Audit (Consultative) Committee, Mr Alex Downie OBE MLC added:

‘We have been working, together with the public auditors and Local Government bodies over the past few years to improve financial compliance across the sector. I am pleased to see that the sector is now close to achieving 100% compliance with the current requirements of the Audit Act. This now provides a firm basis on which to introduce a more proportionate approach to the financial regulation of the sector.’

The proposals have today gone out to public consultation and further information can be obtained from the Government website.

Isle of Man Government provides emergency aid for UK humanitarian charities

The International Development Committee (IDC) of the Isle of Man Government has pledged a total of £50,000 in response to three emergency appeals for aid.

Funding has been provided to UNICEF UK for its response to the humanitarian crisis in the Central African Republic and Human Appeal International for their responses to the cyclone in Somalia and the refugee crisis in Niger Republic.

Response to children affected in the Central African Republic

Awarded: £20,000

Over the past 12 months the Central African Republic has experienced escalating internal conflict, affecting approximately 4.6million people. The United Nations has declared the situation as a level 3 emergency (the highest emergency level). UNICEF’s project will protect displaced children from the risk of violence and human trafficking whilst also providing water and sanitation facilities to refugee camps.

Emergency response to early recovery needs of the people affected by cyclone in Somalia

Awarded: £15,000

On the 10 November 2013 a cyclone hit the North-East coast of Somalia. According to local authorities more than 300 people lost their lives, some 50,000 people are severely affected and more than 100,000 livestock died. The funds granted by the IDC will provide 114 families with food packs to meet the early recovery needs of those most vulnerable and affected families.

Emergency relief for Refugees in Niger Republic

Awarded: £15,000

More than 40,000 refugees have fled the Northern Nigerian border in the Niger Republic. The influx of people into the country is placing further strain on a country which struggles with food insecurity due to years of drought. The project will provide emergency relief to the refugees by providing access to food, water and sanitation facilities.

‘At this time of the year we are reminded of the humanitarian messages of loving our neighbours and looking after those people less fortunate than ourselves. As we look forward to celebrating Christmas it is good to know that our small Island nation is in a position to help some of the many millions of people who will be suffering this Christmas.’

Tax agreement with Seychelles comes into force

Following completion of the ratification procedures, the Isle of Man’s Agreement for the Avoidance of Double Taxation and the Prevention of Fiscal Evasion with Respect to Taxes on Income with the Republic of Seychelles entered into force on 16 December 2013.

The agreement was signed in the Isle of Man on 25 March 2013 by Eddie Teare MHK, the Isle of Man’s Treasury Minister, and by Pierre Laporte, the Seychelles’ Minister for Finance, Trade and Investment, in Seychelles on 28 March 2013.

Chief Minister welcomes restoration of direct flights to Scotland

Chief Minister Allan Bell MHK has welcomed confirmation that the direct air link between the Isle of Man and Scotland will be reinstated from Spring next year.

The Citywing service to and from Glasgow airport will operate nine return flights a week when it commences at the end of March 2014.

The move follows an agreement between the Chief Minister and the Scottish First Minister Alex Salmond MSP – announced when Mr Salmond visited the Island in July this year - that their two governments would work together to seek the restoration of the direct air connection.

Mr Bell commented:

‘The return of direct flights between the Isle of Man and Scotland is good news for both countries and an example of what can be achieved when we act in partnership with our neighbours.

‘Alex Salmond’s visit to the Island this summer was part of our ongoing programme of external relations engagement. It provided an opportunity to discuss matters of mutual interest and one of the concerns raised was the loss of our air services to Glasgow and Edinburgh.

‘We agreed that our two governments would work together to see if the air link to Scotland could be reconnected, and I am delighted that this is now happening. It is particularly pleasing that the new service will be in place in time for the Commonwealth Games in Glasgow at the end of July, in which the Isle of Man team will be competing.’

The Chief Minister added:

‘The good news on Scottish flights is further welcome clarification of the Island’s air services following confirmation from British Airways that they intend to operate three return flights a day to and from London City from end of March next year.’

Chief Minister looking forward to working with Lord Faulks

Chief Minister Allan Bell MHK says he is looking forward to working with Lord Faulks QC to help maintain the positive relationship between the Isle of Man and United Kingdom Governments.

Lord Faulks has this week been appointed as the Minister of State for Justice with responsibility for the Crown Dependencies.

The Conservative peer will replace Lord McNally who announced that he was standing down from his position at the Ministry of Justice (MoJ) to take up an appointment as Chair of the UK Youth Justice Board.

Simon Hughes MP, the Liberal Democrat deputy leader, has also been appointed to the MoJ as part of the mini reshuffle.

The MoJ manages the UK Government’s constitutional relationship with the Crown Dependencies and has been instrumental in building a better understanding of the Isle of Man among MPs and UK Civil Servants.

The Chief Minister said:

‘Lord McNally has been a very good friend to the Isle of Man over many years. He has played a leading role in promoting greater awareness of the Island across Whitehall and strengthening our partnership with the UK in both political and practical terms.’

‘I have spoken to Lord McNally this week to wish him well in his new role and to convey my personal gratitude, and that of the Isle of Man, for his support during his three and a half years as UK Minister with responsibility for the Crown Dependencies. He put in a considerable amount of hard work on our behalf at a time when the Crown Dependencies were subject to unprecedented external scrutiny. His openness and willingness to engage, no matter how difficult the issue, has been most appreciated.’

Mr Bell added:

‘I am sure Lord McNally will share with Lord Faulks his knowledge and experience of working with the Isle of Man to ensure a continuity of understanding.

‘The relationship between the Isle of Man and United Kingdom Governments is the best it has been for some time and I look forward to working with Lord Faulks in the months and years ahead to build on those solid foundations.’

Check your passport if you are planning to travel off-Island

Local residents planning to travel off-Island are being urged to check the validity of their passports.

The reminder has been issued by the Isle of Man Passport and Immigration Office.

The office, which is located on the ground floor of Government Offices, Bucks Road, Douglas, handles all passport applications and renewals, as well as issues regarding immigration and nationality.

Anyone seeking further information can call one of the Passport and Immigration Office enquiry and advice lines –passport +44 1624 693222 or +44 1624 685208, nationality +44 1624 686283. Support will be provided wherever possible.

Over the festive period the office will be closed from 4pm on Tuesday, December 24 until 9.30am on Monday, December 30, and again from 4pm on Tuesday, December 31 until 9.30am on Thursday, January 2.

Anybody who discovers their passport is out of date, and requires a passport by a guaranteed date, can take advantage of the five working days or one-day express service, subject to certain conditions being met. It is recommended that express applications are made in person.

Prison brings festive cheer to Jurby

Prisoners, their families and prison staff will bring some festive cheer to Jurby this week, with the donation of 17 Christmas food hampers to elderly people living in the village.

The well-stocked yuletide boxes are the result of the fifth annual Christmas Hamper Appeal to be undertaken at the Isle of Man Prison. They will be distributed by representatives from local charity Age Concern.

Many prisoners chose to make cash donations from their own funds towards purchasing food items for the hampers, while prison officers, support staff and visitors also made generous contributions.

Additionally, donations from Shoprite and Manx charity Prison Works helped to boost the festive appeal.

The initiative was coordinated by Administration Officer Helen Callow who said:

‘I really appreciate everyone’s contribution. I never fail to be amazed by the generosity here at the prison and the collective support for the elderly community within the village.’

Michael Coleman MLC, Member of the Department of Home Affairs with responsibility for the Prison and Probation Service, added:

‘It’s encouraging to see the prisoners joining forces with staff, charities and local businesses in such a positive way. The result of everybody’s efforts is that 17 families and individuals in the Jurby area will receive a welcome early Christmas gift this year.’

Public asked to 'choose well' when accessing health services over the festive period

The public are being asked to ‘choose well’ if they need to access health services over the festive period. Despite Christmas and New Year being a time of rest and relaxation for many, the Department of Health keeps key services running all year round. By asking the public to ‘choose well’ the Department is emphasising the role the public plays in selecting the most appropriate method of care.

Outside of normal working hours and during public holidays, it’s easy to assume that the only care available is a trip to Accident and Emergency or calling an ambulance. Whilst these should always be the first port of call in an emergency, numerous services continue to operate over the festive period, either with reduced hours or with emergency drop-in clinics.

Parents informed of school review outcomes

This week three primary schools – Cronk-y-Berry, Kewaigue and St John’s – will share with parents the comments from an external validation of their School Self Review and Evaluation (SSRE).

The process of SSRE is continuous and entails schools reviewing all aspects of their work and making judgments about what they are doing well and where they need to take action to secure improvement, explained Martin Barrow, Director of Education. The possible judgments are ‘significant strength’, ‘good’, ‘satisfactory’ and ‘action required’.

‘This process supports schools in having a clear view of how to build on their strengths to ensure they continue to offer the best possible learning opportunities to pupils,’
Mr Barrow said.
‘The Department of Education and Children believes the process has proved very effective in helping schools to improve their practice.’

To support schools in confirming that the judgments they have made are accurate, the process has an external element built in to it.

The first external validation cycle took place from 2008 to 2011 and a second validation cycle commenced in September 2013, Mr Barrow explained.

It involves an external validator, together with a DEC adviser, working with headteachers to review the evidence schools have used to make judgments and to quality assure their accuracy. The validating company, World Class Learning, was chosen from a number of companies that tendered for this work.

Any areas for improvement or further dissemination of best practice are then identified in the annual School Improvement Plan and supported by the school’s link adviser.

Mr Barrow said:

‘The main aim of the validation process is to provide professional support to schools to help them to refine their own judgments. When a school has been involved in this validation process, they will take the opportunity to share key outcomes with parents.’

Primary pupils put new orienteering course to the test

Pupils from Cronk-y-Berry Primary School put a new orienteering course to the test today.

The course, at Archallagan plantation, has been created by William Higgins, a teacher at the school, and the Department of Environment, Food and Agriculture (DEFA).

DEFA is working with partners across the Island to encourage use of its land for healthy outdoor activity.

Orienteering involves navigating a course in as short a time as possible and can be completed by runners or walkers, meaning it’s a sport all ages can enjoy.

Mr Higgins came up with the idea for an orienteering facility at Archallagan after it was used for an international event two years ago. He inherited the map from that event and has spent the autumn laying out the course, installing 48 DEFA-supplied posts and way-markers.

‘Red and white control markers have been mounted on posts located at locations throughout the plantation,’

Mr Higgins explained.

‘Various courses start and finish at different car parks around the plantation and make use of forestry roads, tracks and paths over the different types of terrain.

‘Some courses follow major tracks and forestry roads, so provide a straightforward route to follow and a good way to try orienteering for the first time. Others cross more difficult terrain and are more challenging.’

Sam Corlett, Robbie Hughes, Juan Crossman and Kei Amos, Year 11 students at Queen Elizabeth II High School, fixed caps on to the posts as part of an environmental course that counts towards their Asdan Silver Award.

Taking part in the project not only enabled the boys to practice their navigation skills but led them to experience a new environment and they especially enjoyed going off the beaten track in search of more challenging posts located in pits and behind knolls.’

Robbie said:

‘It is a healthy and environmentally friendly course as people can walk, run or cycle while navigating from post to post. It is quite flat and not too steep.’

Twenty-eight pupils from Cronk-y-Berry became the first to try the course today and pronounced it challenging and fun.

Brenda Cannell MHK, Member of DEFA with responsibility for Forestry, commented:

‘The Department is always keen for the public to take part in new healthy outdoor pursuits and this activity complements the cycling, walking and horse riding that already takes place at Archallagan. We hope that the way-marked orienteering course will not only prove useful for people wishing to improve their navigational skills, but will encourage them to explore one the Island’s oldest and largest commercial plantations.’

Mr Higgins said those trying out the course should wear clothing and footwear suitable for the terrain and respect other plantation users. Access to the plantation is restricted at times due to forestry work or sporting events such as mountain biking, rallies and motorbike trials.

The map and downloadable route cards will be available on the Isle of Man Government’s website early in the New Year.

The Isle Of Man Companies Registry quality management system has been certified as complying with the requirements of ISO 9001:2008 following a review by Lloyd’s Register Quality Assurance.

Minister for the Department of Economic Development John Shimmin MHK presented the Certificate to the staff of the Companies Registry and commented:

An Image A Day

Juan studied at Castle Rushen High School and the IOM College before gaining a BA Hons degree in illustration at Falmouth University in 2006. He went on to become Artist in Residence at the Courtyard Gallery in Tynwald Mills before staging solo exhibitions at the Sayle Gallery. In 2010/2011 the Arts Council funded a project entitled ‘Welcome to the Neighbourhood’ which saw Juan stage exhibitions of original work in venues not immediately associated with art such as The Courthouse, Tanroagan, the Villa Marina Arcade and a vacant shop unit in Douglas.

More recently Juan has been part of the Oscar-nominated animation team for the film ‘Chico and Rita’ and this year graduated from Bournemouth University with an MA with Distinction in 3D computer animation.

Juan said:

“It is important to me that that my work can be understood and enjoyed by anyone. I like to express odd little ideas and thoughts, that I think we all have, albeit I represent them in sometimes comedic and surreal ways, and most importantly I like a challenge. That's where ‘An Image A Day’ comes from really, it's a simple yet an ambitious project. Creativity is a funny thing, inspiration can strike and give you a hundred ideas, or it can forsake you for months. It is this element of relying heavily on inspiration and visual problem solving that intrigues me about such a project. I've chosen to do the project as a blog as this will allow me to explore all sorts of different media. The idea of producing work that will only appear online rather than in a physical space will allow me to explore working with mixed media and even producing works entirely digitally. I'm incredibly excited to begin work on the project and I'm very pleased for it to be a part of the Island of Culture.”

Additionally, Isle of Man Post Office has commissioned a set of stamps for Island of Culture that have been designed by Juan. The stamps will be launched officially on 6 January 2014 but can be pre-ordered online now at www.iomstamps.com. They will also be available from the Post Shop at Regent Street Post Office, Douglas from January 6.

The Terrorist Asset-Freezing Etc. Act 2010 (of Parliament), as it applies in the Isle of Man, implements the terrorist asset-freezing requirements of UN Security Council Resolution 1373 (2001) and Council Regulation (EU) No 2580/2001.

Tynwald votes to continue ban on 'legal high'

Tynwald voted in favour of extending the ban on the so called ‘legal high’ MDAI for a further one year period at its sitting in December.

MDAI will remain a Class C drug under the Misuse of Drugs Act 1976 with effect from 1 January 2014, which means that the ban will continue uninterrupted.

Minister for Health, David Anderson MHK, who tabled the Order said:

'This is the third time an Order to ban MDAI, has been approved by Tynwald by classifying it as a Class C drug. It was first banned in January 2012. The move to make MDAI a controlled substance followed advice from the Island’s Advisory Council for the Misuse of Drugs in response to the tragic loss of life of a local teenager. MDAI is not banned in the UK. Legal highs continue to pose a problem due to their impact on personal health and wellbeing and I am glad that my colleagues in Tynwald have voted to extend this ban, which I believe remains in the best interests of our community.'

The new Order will again be effective for 12 months, after which time a further Order can be made, subject to Tynwald approval.
