The European Commission has amended Annex I to Council Regulation (EC) No. 753/2011 ('the 2011 Regulation') with effect from 21 December 2012..

Annex I of the 2011 Regulation lists the persons, groups and entities covered by the freezing of funds and economic resources under that Regulation. The amendments reflect the decision made on 20 November 2012 by the United Nations Sanctions Committee established pursuant to resolution 1988 (2011) to add one individual and one entity to the UN list.

Following the publication of Council Implementing Regulation (EU) No 1264/2012 in the Official Journal of the European Union, the Council of the European Union has amended Annex IX to Council Regulation (EU) No 267/2012 ['the 2012 Regulation'], with effect from 22 December 2012.

Annex IX to the 2012 Regulation lists persons, entities and bodies identified by the Council under Article 23(2) of that Regulation as subject to the financial sanctions imposed by that Regulation.

One individual and 18 entities have been added to Annex IX, 2 entities removed, and amendments to the identifying information of 3 existing entries in Annex IX.

The individuals and entities added to Annex IX are therefore subject to the Asset Freeze imposed by the 2012 Regulation.

The entities removed from Annex IX are no longer subject to the asset freeze imposed by the 2012 Regulation.

Treasury Minister leads programme of engagement with Island business community

Meetings have taken place with representatives from a cross-section of industries to discuss the Isle of Man’s economic outlook for 2013 and beyond. Treasury is currently working up a Budget framework and projections for the next three years to assist Government departments with their long-term planning.

The focus will again be on progressing Government’s core priorities of stimulating economic growth, rebalancing Government finances, and protecting the vulnerable. Minister Teare and Treasury colleague Phil Braidwood MLC, together with Alan Crowe MLC, the member of Economic Development with responsibility for financial services, have so far held 40 meetings with key individuals across economic sectors including financial services, engineering, manufacturing, e-gaming, construction, retail and real estate.

Those views will be fed into the Budget process alongside a wide range of other public and social considerations, as Treasury seeks to strike a fair balance for the people of the Isle of Man.

The Minister said:

‘Preparing a Budget is a complex challenge, with a multitude of domestic and international factors to take into account. We always try to look at the bigger picture and act in the best interests of the Island as a whole when drawing up our proposals. The business community obviously has a vital contribution to make and Mr Braidwood and I have gained a valuable insight into current thinking during the course of our many meetings.Treasury has always taken soundings from local businesses when preparing a Budget and this year I have sought to formalise those arrangements by leading a proactive programme of engagement. Working with the private sector to create the right environment to attract new business and help existing sectors to grow is crucial to the Island’s future prosperity.’

Mr Teare said that while Government’s budget strategy remained on target, difficult decisions would still be needed in order to complete the rebalancing process by 2016 as planned. External factors, such as reduced economic activity in the UK and the threat of a triple-dip UK recession, would also have an impact on the Island, the Minister explained.

He commented:

‘We have made solid progress in our work to put public finances back on an even keel, but tough political decisions will have to be made in the years ahead. There is certainly no room for complacency as Government finances are very different now as a result of the changes to the VAT sharing agreement with the United Kingdom. One of the biggest challenges is to make the necessary changes to address our fiscal situation while avoiding a slash and burn approach that could potentially destabilise a Manx economy that is still showing positive growth.’ Mr Teare added: ‘We are out in the community listening to people’s views, concerns and aspirations, and gathering information that will help to shape our efforts to secure the Isle of Man’s long-term sustainability.’

Patrol vessel Isle of Man makes first arrest in Sierra Leone

Speaking at a press conference held in Freetown earlier this week, the Sierra Leone Minister for Fisheries and Marine Resources, Hon Dr S Kabia, confirmed that the patrol vesselIsle of Manhad detained a vessel suspected of fishing illegally in Sierra Leonean waters. The vessel was picked up during a routine patrol, and was displaying a false identity and call sign. Further investigations are ongoing to ascertain the identity of the vessel in question.

Dr Kabia said:

'Sierra Leone will be consistently tough on illegal operators. They are undermining our country’s economy and development. I have not hesitated to use the full force of the law against them, and the donation of the patrol boat by the people and Government of the Isle of Man has given us a powerful resource to do just that.'

Welcoming this news, DEFA Minister Phil Gawne MHK, Chair of the Isle of Man Overseas Aid Committee, said:

'I was absolutely delighted to be contacted by Minister Kabia confirming this news. The ex-Isle of Man customs vessel, which was donated by the Isle of Man Government in September, is already acting as a notable deterrent to illegal poaching. This detention will send a clearer message to those wishing to plunder Sierra Leones fisheries that the days when they could get away with this are numbered. I am very pleased to hear that the vessel continues to perform well. Healthy fisheries are the most important source of protein for Sierra Leone’s people, and this donation is clearly having a benefit to the nation as a whole that is worth many times the value of the vessel itself. Recent improvements in fisheries policy and enforcement in Sierra Leone have resulted in over $30 million per annum in increased legally caught fish sales and a large proportion of this increased economic value is as a result of Isle of Man support.'

India visit raises Isle of Man profile

During the 5-day visit to India, Michael Charlton, International Director, and Steven Beevers, Head of Special Projects, accompanied by local industry representatives, met with a range of senior business people in Mumbai.

As well as hosting a dedicated Isle of Man networking event and private meetings with professional intermediaries, the Island was also represented at the International Taxation Conference, held in Mumbai. The conference, one of the leading regular taxation conferences in the world, was organised by the Foundation for International Taxation (FIT), and was attended by around 500 professionals.

Greg Jones, Tax Director at KPMG Isle of Man, spoke at the conference on the topic of 'Opportunities for doing business in the UK and EU through the Isle of Man', which offered an insight into the propositions most of interest to India. These included the Isle of Man as a trading and sales administration base for the EU, shipping and aviation services and UK commercial property ownership.

The visit builds upon a visit undertaken in May this year by Michael Charlton and industry representatives plus London-based initiatives hosted earlier in the year for City-based Indian professionals, given the importance of the City for Indian business and wealth.

Michael Charlton, International Director, Department of Economic Development said:

'With an impressive current growth rate of over 5.0%, India remains a key market for the Isle of Man, but a long term view for business needs to be taken. The FIT Conference was an opportunity to help build the Island's profile with the professional community in India and this has resulted in a number of leads and opportunities for industry to follow up on.'

Alan Crowe MLC, Department Member for Financial Services and Country Strategy said:

'The Isle of Man had established itself as India’s leading choice for AIM market listings prior to the credit crunch and there are signs, evidenced from this visit, that this is likely to pick up again in the near future. With its high growth economy, India also has an increasing requirement for global wealth management services and the Isle of Man is ideally placed to meet these requirements. The Department has a well-defined Country Strategy in place for India and it will be responsive to all the opportunities that arise from key visits such as these.'

Annex I to Council Regulation (EC) No 881/2002 has been amended, following the publication of a Corrigendum to Council Implementing Regulation (EU) No 1155/2012.

The amendment clarifies the position in respect of an entity removed from the UN Al-Qaida list pursuant to the United Nations Security Council (UNSC) Committee decision of 26 November 2012.

The entity whose name has been removed from Annex I is no longer subject to the asset freeze imposed by Council Regulation (EC) No 881/2002.

Infrastructure announces an increase to Building Regulation Fees

Copies of the new Regulations will be available after 1 January 2013 to purchase from the Planning and Building Control Division of the Department of Infrastructure, first floor in Murray House, Mount Havelock, Douglas or the Government Central Reference Library in Government Offices, Douglas. Alternatively, see Making a building control application.

In general, the fees have increased above the rate of inflation. However, the new structure will still mean that the Isle of Man remains more competitive, and cheaper, in its Building Control fees than many other jurisdictions, including England and Scotland.

Howard Quayle MHK, Department Member with responsibility for Planning and Building Control, explained:

‘It is important that Building Regulations fees are increased to maintain a cost-effective and valued service. The move will help the Building Control Authorities to recover a greater percentage of the costs incurred and achieve a reduction on the burden on tax and rate payers in delivering the service we provide and, as a result, help ensure we can continue to maintain the standards of the service.’

Guidance notes for the Regulations are available now free of charge from the Planning and Building Control Division.

The move, approved by the Council of Ministers, will save the taxpayer an additional £1 million each year between 2013 and 2018. At the end of the period the Island’s Local Authorities, which are legally responsible for domestic waste collection, will be paying the full cost of disposal at the Energy from Waste facility.

Infrastructure Minister David Cretney MHK explained

'At a time of considerable pressure on budgets, the public expects Government to prioritise its spending to support frontline services.’

The Minister added

‘The Department is keen to empower Local Authorities by giving them more control and responsibility for their finances and services. I have every confidence that they will respond positively to this challenge by working together to cuts costs.’

The Department says it cannot direct Local Authorities as to how they deal with the withdrawal of the waste subsidy. But if they chose to pass the cost straight through to householders it should mean a rates increase of around £11 annually for 6 years for a typical 3-bedroom terraced house, with an average increase of around £22 per household per year. Local authorities have benefited from subsidised disposal costs since the Energy from Waste facility opened in 2004.

Young people obtain youth work qualifications

Lauren Stoutt, 19, and Kyle Collister and Anthony Cooper, both 17, have completed a level one course in Volunteering in a Youth Work Setting at Ramsey Youth Club via the Open Awards.

Grainne Burns, a Youth Officer with the Department of Education and Children’s Youth Service, said:

‘This is an accredited course outlining the basics of youth work and the challenges that can occur when working with young people. It has allowed them to be better prepared in planning sessions and understanding group dynamics. As a result of child protection training, they are more aware about keeping young people safe, too.’

Grainne, who was the trio’s tutor, said:

‘They worked hard in classroom sessions and then went back to the club and put what they had learned into practice. They then combined their learning and experiences in a portfolio of evidence, which was assessed by Open Awards.’

Vida Porter, Youth Worker at the Ramsey club, which meets at Auldyn School in the town on Monday and Thursday evenings, said completing the course had given the three ‘a much greater insight into the diversity of youth work’.

The Youth Service runs 53 different projects a week for young people aged 8 to 21 (or 25 including the Duke of Edinburgh’s Award). Its youth workers must gain a level two Introduction to Youth Work qualification and some move on to study for a more advanced qualification.

Young people in schools and youth clubs have already gained Open Awards qualifications in sound and lighting and mentoring, while those engaged with the Future You project, which is assisting young people not in education, employment or training, are working towards other qualifications with the body.

Financial Sanctions: Belarus - Egypt - Iran - Tunisia

Belarus - Council Regulation (EU) No. 1014/2012 was applied. This Regulation replaces the previous three lists of those subject to sanctions with a single, amalgamated list in new Annex I to the original 2006 Regulation (Council Regulation (EC) No. 765/2006).

Egypt - Council Regulation (EU) No. 1099/2012 was applied. This allowed for the release of frozen assets to satisfy claims which were the subject of judicial or administrative decisions pre-dating the inclusion of the person involved in the list of those subject to sanctions in Annex I to Regulation 270/2011.

Iran - Council Regulation (EU) No. 1067/2012 was applied. This provided for a further exemption in relation to those listed in Annex IX to Regulation 267/2012 to have effect from 16 November. The amendment provides that the prohibitions in the asset-freezing prohibitions of Regulation 267/2012 shall not apply to acts and transactions carried out with regard to entries listed in Annex IV -

which hold rights derived from an original award before 27 October 2010, by a sovereign Government other than Iran, of a produciton sharing agreement as referred to in Article 39 of Regulation 267/2012, in so far as such acts, and transactions relate to those entities' participation in that agreement; and
in so far as necessary for the execution, until 31 December 2014, of the obligations arising from contracts referred to in point (b) of Article 12(1) of Regulation 267/2012 provided that those acts and transactions have been authorised in advance, on a case-by-case basis, by the competent authority concerned and that the State concerned has informed Member States and the Commission of its intention to grant an authorisation.

Tunisia - Council Regulation (EU) No. 1100/2012 was applied. This provided for the release of frozen funds under certain defined circumstances, and also allowed for their release where necessary for the purpose of assisting in the recovery of misappropriated assets.

The relevant Sanctions Notices on the Customs and Excise website have been updated.

Isle of Man Government champions e-gaming sector in Europe

The visit, organised by the Manx Government’s permanent Brussels Office located in the heart of the EU quarter, enabled the Island to make the case that accelerated growth of the sector and high standards of consumer protection are not mutually exclusive. Meetings were held with the European Commission’s Directorate General for the internal Market, the European Gaming and Betting Association and the Remote Gambling Association.

Steve Brennan, Chief Executive of the Isle of Man’s Gambling Supervision Commission, said:

'This was an important set of engagements and I was struck by the openness of the EU Commission staff and their appetite for the type of external expertise that we are in a good position to offer, given our longstanding and successful track record in regulating this high growth sector, to marry the interests of providers and the protection of consumers effectively.'

Tim Craine, the Department of Economic Development’s Head of E-Gaming added:

'The Brussels Office was able to identify precisely the right people with whom to engage, provide access to them and offer concrete ideas for follow up which we will, together, be pursuing in the New Year, including plans for an exciting event in the European Parliament. It is clear to me that having a permanent presence in Brussels adds real value to the Island’s efforts to secure economic success for the medium to long term.'

The IoM’s e-gaming sector is going from strength to strength and now accounts for 8% of GDP and provides some 700 jobs on Island.

Patrick Bourke, the Isle of Man's European Affairs Director, summed up:

'It was a pleasure to welcome Steve and Tim to Brussels. Their visit enabled the Brussels Office to demonstrate the real added value it can bring to the Island. The EU Institutions can appear, from the outside, as a difficult proposition in terms of engagement but the reality is somewhat different. With clear objectives, the Island can make its voice heard. As I said when I was first appointed, while we need to be mindful of our relative size and negotiating weight, the Island can and should be ambitious and confident in its international dealings, including with the EU.'

The European Commission has amended Annex I to Council Regulation (EC) No. 881/2002 ('the 2002 Regulation') with effect from 12 December 2012.

Annex I to the 2002 Regulation lists the persons, groups and entities covered by the freezing of funds and economic resources under that Regulation.

The amendment reflects the decision made on 5 December 2012 by the United Nations Sanctions Committee established pursuant to resolution 1267 (1999) to add 1 entity to the UN Al-Qaida list.

Island's Healthcare Professionals host 'Procedures, Placebos and Poppycock'

Local members of the Society, Michelle Breed, Acting Therapy Services Manager and Mr Ian Wright, Consultant Orthopaedic Surgeon, approached the Society to hold the international conference in the Isle of Man as it would be the ideal venue. Other venues for this prestigious event have previously included Cambridge, Belfast and Odense.

Minister for Health, David Anderson MHK said:

'Opportunities like this do not come round often; it is brilliant that the Society for Back Pain Research has chosen the Island as a venue to hold their AGM. I applaud Michelle and Mr Wright’s initiative in organising and securing the conference; this will, undoubtedly, raise the profile of the Island as an international setting for such prestigious events.'

Michelle explains:

'The Isle of Man transport and hospitality sectors really pulled together to make the conference affordable for those who attended. The Isle of Man Steam Packet Company, taxi firms, local hotels and guest houses all provided special delegate rates. Student members could attend the conference and stay on the Island for two nights for under £200. The lively atmosphere was enhanced by local band Retrospect, fronted by Noble’s Hospital’s Obstetrician and Gynaecologist Mr Mike Divers.'

The conference is a forum where innovative new therapies and established treatments are scrutinised in a rigorous scientific atmosphere. The research papers and posters are peer reviewed and the abstracts are published online in the Journal of Bone and Joint Surgery.

Michelle continued:

'This conference was an opportunity for local clinical practitioners who treat acute and chronic back pain to be able to evaluate their service provision in line with the new evidence and research that was presented. It has put the Island on map as a viable location for such events; it also demonstrates that we can hold our own in an international arena. I would like to thank all the local companies who have helped to make this conference a success.'

Seventy-two delegates attended the conference, who heard from speakers from a variety of different backgrounds presenting on a range of topics. The guest speakers included; Lecturer, Dr Anne Redgrave, Doctor to the British Olympic Rowing Team, who presented on managing back pain in elite rowers, and Professor Andrew Carr Nuffield, Professor of Orthopaedics and Musculoskeletal Sciences University of Oxford, who spoke about the ‘Ethical and Practical Issues with Placebo Surgery in Clinical Trials’.

The conference finished with an award ceremony. The Local Organisers Award for best contribution to the theme of the event, which Michelle and Mr Wright agreed to judge and which was sponsored by Noble’s Hospital, was awarded to T. Pincus and J. Henderson for their presentation on ‘Low back pain patients ratings of videos depicting feared movements’.

Mr Wright said:

'It was a wonderful opportunity and a great success for our local and international delegates to share new ways of working and best practice, and will hugely benefit our patients and staff in the Isle of Man.'

Isle of Man introduces legislation to outlaw vulture funds

The Heavily Indebted Poor Countries (Limitation on Debt Recovery) Act 2012 outlaws a practice that undermines international debt relief efforts. The legislation prevents vulture funds from buying up poor nations' debts for a fraction of their original amount and then using the courts to sue for the full value, plus interest and penalty charges.

Treasury Minister Eddie Teare MHK said the move sent a clear message that the Isle of Man was a well-regulated, transparent and co-operative country.

Mr Teare said:

'We have no evidence of vulture fund activity in the Isle of Man and as an internationally responsible country we do not want it here. This legislation will ensure our Island is not used for the disreputable business of exploiting Heavily Indebted Poor Countries.'

The new law, which is equivalent to the UK Debt Relief (Developing Countries) Act 2010, supports an international initiative to provide debt relief to heavily indebted low income countries. The IMF and World Bank estimate that vulture funds are seeking total claims of $1.47bn from countries including Cameroon, Ethiopia, Sudan, Uganda, and the Democratic Republic of Congo.

Minister Teare said:

'Legislation to block vulture funds is further evidence of the Isle of Man’s commitment to playing a full and constructive role in the global community. The Island’s support for the Small Countries Financial Management Programme has earned positive international recognition, and we remain at the very forefront of developments in terms of tax transparency and co-operation.'

The Isle of Man's decision to outlaw vulture funds has been welcomed by Eric LeCompte, Executive Director of Jubilee USA Network, who met Minister Teare in Tokyo in October at the 2012 meetings of the World Bank, IMF and Commonwealth Finance Ministers.

Mr LeCompte, whose organisation has helped to secure important global financial reforms, said:

'We are living in a time when hedge funds known as vulture funds are making enormous profits on the backs of the world's poorest people. The people of the Isle of Man courageously have stood with the world's most vulnerable and we offer an invitation to governments around the world to stand with them.'

Welcome boost to Island's air passenger numbers

Again it was the routes to the Island’s biggest air travel markets - the North West and London - that defined the overall trend. All three North West routes from the Island saw increases, with Liverpool leading the surge with a 15% rise. This was fuelled by additional frequency and capacity introduced by easyJet, boosting their departures to 11 A319 Airbus flights weekly, this being in addition to the 24 flights weekly flown by Flybe. London traffic increased by over 20%, again driven by the 3,800 passengers using the new easyJet 4 weekly service to Gatwick, supplementing the 26 weekly operated by Flybe, and this also came with a 15.7% increase in London City passengers generated by the BA CityFlyer triple-daily service.

Ann Reynolds, Airport Director, was reassured by the reversal in passenger numbers, but was under no illusions about whether the solid November increase had signified improved market conditions.

'The last 7 months has been tough for our airlines and this coming winter will be even more difficult for the industry,' she said. 'What we are currently seeing is that the primary markets are responding positively to very competitive fares brought about by competition between carriers. It can be seen that, when stimulated, and despite tough economic times, the air travel market to and from the Island can respond with new traffic being generated.'

'However, the other side of the coin is that the small regional routes are increasingly suffering with declining passenger numbers,” she added. “Indeed, the recent decision to suspend a number of routes in January, for the winter period, together with the withdrawal of the Jersey service, underlines the hard times our airlines are having.'

Leeds, Luton and Jersey routes all experienced declines during November with Leeds and Luton 25% and 30% down respectively. Oxford was 40% below the forecast level. Jersey was only slightly below November 2011, but has seen a constant decline since 2008. Birmingham also fell by 13% and Belfast by 10%.

On a positive note, both of the Loganair Scottish routes have demonstrated improvements in traffic levels recently with Glasgow leading the way with a 19% increase. Manx2.com’s Gloucester service was up by 11% whilst their Blackpool route saw a small increase, and at the same time Flybe recorded a similar percentage rise in their Manchester passengers and similarly Aer Lingus with Dublin.

With just one month to go, despite the reversal in November, it is expected that 2012 will result in a small overall decline in passengers for the Airport. Provisional forecasts for 2013 indicate a slow but steady return to growth, but the outturn for next year will be again dependent upon the UK and European economies showing signs of improvement.

This is a point that Departmental Member for Ports, David Callister, again stressed.

'The current economic climate, together with the pressures placed upon airlines from Airport Passenger Duty taxation, makes it an incredibly tough call for our airlines to maintain and grow routes to and from the Island' he said. 'This is especially the case for the smaller, or 'thinner' routes, which are so important to us, our economy and the ability for residents to access points throughout the UK and visitors to choose to come to the Island. We are desperately disappointed to see the suspension and withdrawal of some of these routes, but we will be working with our airlines over the coming months to try to provide the necessary encouragement for suspended routes to be resumed next summer, whilst maintaining the well proven strategy to generate new routes when the economic climate improves.'
