OFT Responds to Consultation on the Implementation of Unfair Terms in Consumer Contracts

The Office of Fair Trading has today published its response to the recent consultation on the implementation of the outstanding provisions of the Fair Trading (Amendment) Act 2001. The OFT Chairman David Quirk MHK thanked those who had contributed to the consultation and advised,

“Given the passage of time since the 2001 Act was introduced, we felt that we should consult the public before the remaining provisions were brought into effect. Having considered the comments received we believe that the rest of the Act should be brought into force as soon as possible in order to provide consumers with the level of protection which Tynwald originally felt was needed”.

Responsibility for making the Appointed Day Order, which will require approval by Tynwald, rests with the Minister for Community, Culture and Leisure and the OFT will be proposing an implementation date of 1 April 2014.

The Summary of Responses to the Consultation on the implementation of Legislation in relation to Unfair Terms in Consumer Contracts is available at www.gov.im/oft/consultations.
