Endorseable fixed penalty notices

Tuesday, 1 April 2014

The Isle of Man Constabulary will have the power to issue endorseable fixed penalty notices for certain motoring offences from today, Tuesday 1 April.

The move is aimed at reducing the number of low-level/high-volume driving offences dealt with by the Isle of Man Courts.

It is among a package of measures being introduced as part of the Criminal Justice Strategy and is expected to generate cost savings of £100,000 a year.

With the agreement of the driver, police will be able to issue a fixed penalty notice for certain offences. This will result in a fine and penalty points being imposed, but will remove the need for the motorist to attend court.

The police approach to enforcement will not change; it will still be proportionate and action will only be taken when necessary.

A driver who does not wish to accept a ticket can elect to receive a summons for a future court appearance.

It is intended that the introduction of fixed penalty notices will free up court time to ensure that more serious cases can be heard sooner. This will in turn help to reduce the impact on victims and witnesses, while improving efficiency.

Home Affairs Minister Juan Watterson MHK said:

‘This project has involved the co-operation of the Department of Home Affairs, Department of Infrastructure, General Registry and the Attorney General’s Chambers and is a great example of joined up government seeking to achieve better ways of working.’
