Entry clearance under the Points Based System

The requirements for migrants applying under the Points Based System (PBS) categories can be found in the Isle of Man Immigration Rules. There are 5 tiers of PBS as follows: 

Tier 1

Tier 1 is for highly skilled individuals who will contribute to the growth and productivity of the Isle of Man and consists of the following categories:

  • Tier 1 (Exceptional Talent) migrants - Section 245B - BF of the Isle of Man Immigration Rules
    This route is for exceptionally talented individuals in the particular fields, who wish to work in the Isle of Man. These individuals are those who are already internationally recognised at the highest level as world leaders in their particular field, or who have already demonstrated exceptional promise and are likely to become world leaders in their particular area.
  • Tier 1 (Investor) migrants – section 245E - EF of the Isle of Man Immigration Rules
    This route is for high net worth individuals making a substantial financial investment to the Isle of Man.
  • Tier 1 (Entrepreneur) migrants – Section 245D - DF of the Isle of Man Immigration Rules
    This route is for migrants who wish to establish, join or take over one or more businesses (sole trader, partnership, or a company) registered in the Isle of Man.
  • Tier 1 (Graduate Entrepreneur) Migrants - Section 245F - FC of the Isle of Man Immigration Rules
    This route is for MBA and other Isle of Man graduates who have been identified by Higher Education Institutions as having developed genuine and credible business ideas and entrepreneurial skills to extend their stay in the Isle of Man after graduation to establish one or more businesses (sole trader, partnership, or a company) registered in the Isle of Man.
  • Tier 1 (General) Migrants
    This route is now closed except for indefinite leave to remain applications.

You do not need a job offer when you apply to enter or stay in the Isle of Man under Tier 1, but you will need to pass a points-based assessment.

Tier 2

The Tier 2 routes enable Isle of Man employers to recruit workers from outside the EEA to fill a particular vacancy that cannot be filled by a British or EEA worker and consists of the following categories:

  • Tier 2 (General) Migrants - Section 245HA – HF SD of the Isle of Man Immigration Rules
  • Tier 2 (Minister of Religion) Migrants - Section 245HA – HF SD of the Isle of Man Immigration Rules
  • Tier 2 (Sportsperson) Migrants - Section 245HA – HF-SD of the Isle of Man Immigration Rules
  • Tier 2 (Intra-Company Transfer) Migrants – Section 245G – 245GF-SD of the Isle of Man Immigration Rules

Migrants who apply under the Tier 2 (Intra-Company Transfer) category are not eligible to apply for settlement (also known as Indefinite Leave to Remain or ILT).

If you have been offered a skilled job in the Isle of Man and your prospective employer is willing to sponsor you, you can apply to come or stay here to do that job.

The employer must be an approved licensed sponsor in the Isle of Man. 

 

Tier 3: Not used  

Tier 4: Students (Admission for duration of studies)

The Tier 4 route applies to students with an unconditional offer of a place on a relevant course of studies and Tier 4 applicants must be sponsored by a Licensed Education Provider in the Isle of Man.

Migrants who apply under the Tier 4 category are not eligible to apply for settlement (also known as Indefinite Leave to Remain or ILT).

Tier 5: Youth Mobility and Temporary Workers

  • Tier 5 (Youth Mobility Scheme) Temporary Migrants
    This route is for young people from participating countries and territories who wish to live and work temporarily in the Isle of Man and who are sponsored by a licensed Isle of Man employer. Information can be found at Section 245ZI – ZL of the Isle of Man Immigration Rules.
  • Tier 5 (Temporary Worker) Migrants
    This route is for certain types of temporary worker whose entry helps to satisfy cultural, charitable, religious or international objectives, including volunteering and job shadowing. Information can be found at Section 245ZM – ZS of the Isle of Man Immigration Rules.
  • Temporary Workers – Creative and Sporting
  • Temporary Workers– Charity workers
  • Temporary Workers – Religious Workers
  • Temporary Workers – Government Authorised Exchange
  • Temporary Workers – International Agreement

The maximum period of leave which can be granted to Tier 5 migrants is 24 months. Migrants under this visa  do not qualify for settlement (ILR).

If an employer in the Isle of Man is willing to sponsor you, or if you are a national of a country that participates in the youth mobility scheme, you may be eligible for temporary entry permitting various types of work.

 

Certificate of Sponsorship (CoS) and Certificate of Acceptance for Studies (CAS)

All applicants in Tiers 2 and 5 must provide with their visa application a Certificate of Sponsorship (CoS) from a sponsor who has been approved for entry on the Register of Licensed Sponsors. The CoS acts as an assurance that the migrant is able to do a particular job.

Applicants in Tier 4 will require Confirmation of Acceptance for Studies (CAS) issued by a licensed Isle of Man Tier 4 sponsor.
