EUSS Automatic Extension
The Isle of Man (IoM) is committed to maintaining alignment of the EU Settlement Scheme (EUSS) with the UK’s equivalent Scheme. The EUSS Automatic Extension is a continuation of this existing policy.
In December 2022, a United Kingdom (UK) High Court judgement ruled that, on the basis of article 13(4) of the Withdrawal Agreement, pre-settled status holders should not lose their rights of residence if they do not make an application for settled status.
As a direct result of this all pre-settled status holders under the IoM’s EUSS, were to have their status extended by 2 years, with this automatic extension being applied 28 days before their status was due to expire to ensure that nobody lost their immigration status if they had not already applied to switch from pre-settled to settled status.
On 21 May 2024, The UK Home Office announced that they were to change the duration of pre-settled status extensions from 2 to 5 years.
The IoM replicated this action with all pre-settled status holders under the IoM EUSS had their pre-settled status automatically extended by a further 5 years on 16 December 2024.
This meant that those who have not yet had a 2-year extension applied by 16 December 2024 had their leave extended by 5 years on that date from the date their original leave was due to expire, whilst those who had the 2-year extension applied received a further 5 years leave applied to their new leave expiry.
If you previously held pre-settled status and have subsequently been granted settled status this does not apply.
Pre-settled status holders need to contact the IoM Immigration Service to apply for their updated pre-settled status document.
The updated status document provides proof of right to work, live or study in the IoM, and provides valid permission to enter the IoM, or UK, following travel.
There will be no fee applicable to apply for EUSS Automatic Extension status documents.
It will still be possible to apply for the extension documents even after the original leave has expired. This is because the leave will be automatically extended.
Next steps:
- Complete the ‘EU Settlement Scheme Status Holder Personal Information Form'
- Submit the ‘EU Settlement Scheme Status Holder Personal Information Form’ along with proof of ID (Passport/National ID Card) and proof of address; either:
- In-Person during public counter opening times or
- Hand deliver to the Immigration post box at Central Government Offices or
- By Post to the Immigration Service, Ground Floor, Government Office, Bucks Road, Douglas, Isle of Man, IM1 3PN
- Extension status letters will be sent out using the postal service or can collected, depending on the pre-settled status holder’s option choice
- For those who require a wet ink stamp in their passport, these will require collection during the Immigration Service public counter opening hours

In January 2025, the Home Office announced that from January they are introducing a new process to automatically convert eligible pre-settled status holders to settled status, through a phrased roll out, without the need to make a further EUSS application.
The Isle of Man will not be replicating this process at this time. However, the IoM Immigration Service continue to encourage eligible pre-settled status holders to convert to settled status.
Check if you are eligible for settled status
If you hold pre-settled status in the IoM or UK, and have had continuous residence for a period of 5years’ or more, you are likely to qualify for settled status and are encouraged to apply. Late applications
Non-exhaustive caseworker guidance has been published by the UK Government which will be followed by the Isle of Man Immigration Officers.
How to make a late application
Appendix EU of the Isle of Man Immigration Rules contains full information on the EU Settlement Scheme. The UK Government website has an online eligibility checker for the EU Settlement Scheme.
You can make a late application by submitting a completed application form and supporting documents to the Isle of Man Immigration Service. The forms can be found on our website under visa applications and fees.
If you are outside the Isle of Man you should consider making a late application to the UK EUSS online.

Your rights with Limited Leave to Remain (Pre-settled status) and Indefinite Leave to Remain (settled status)
You’ll be able to:
- Work in the Isle of Man
- Use the NHS for free, if you can at the moment
- Enrol in education or continue studying
- Access public funds such as benefits and pensions, if you’re eligible for them
- Travel in and out of the UK

If you’re an Irish citizen
You do not need to apply for indefinite leave to remain or limited leave to remain if you’re an Irish citizen.
However, if you’re an Irish citizen and your child is not a British citizen, they’ll be eligible for either:
- The same status that you could get, based on how long you’ve lived in the Isle of Man
- Indefinite leave to remain or limited leave to remain, based on their own residence
This also applies if you’re from Northern Ireland and have Irish, British or dual British and Irish citizenship, and your child does not have Irish, British or dual citizenship.
