Financial Sanctions: Somalia

On 13 December 2018 the following Order and Regulations came into operation –

  • European Union (Somalia Sanctions)(Application)(Amendment)(No. 2) Order 2018 [SD No 2018/0333]
  • Somalia Sanctions (Amendment)(No. 2) Regulations 2018 [SD No 2018/0334]

The Order applies Council Regulation (EU) 2018/1933, as part of Island law, subject to certain modifications.

Council Regulation (EU) 2018/1933 substitutes Article 2(3)(a) of Regulation (EU) 356/2010 to update the listing criteria of designated persons or entities following United Nations Security Council (“UNSC”) Resolution 2444 (2018). The amended designation criteria now make it possible for the UN Sanctions Committee to sanction persons who commit acts involving sexual and gender-based violence, irrespective of applicable international law in Somalia.

The Regulations amend the Somalia Sanctions Regulations 2010 (“the principal Regulations”), to take account of the amendment of Council Regulation (EU) 356/2010 by Council Regulation (EU) 2018/1933, as these EU instruments have effect in the Island

These Regulations also replace paragraph 3 to the Schedule to the principal Regulations to extend the provisions for the disclosure of information and documents in connection with compliance with the EU Regulation. 

The principal Regulations established offences and penalties for breaches of Council Regulation (EU) 356/2010, as applied to the Island.
