Financial Sanctions: Ukraine

This news release is issued in respect of measures taken against certain persons, entities and bodies in view of the situation in Ukraine and should be read in conjunction with the information published on 19 September 2017.

Annex I to Council Regulation (EU) No 269/2014 has been amended with effect from 16 September 2017, following the publication of Council Implementing Regulation (EU) No 2017/1549.

Thirty three entries have been amended and are still subject to an asset freeze. Details of the changes can be found in the attached Annex to this news release.

Financial institutions and other persons are required to check whether they maintain any accounts or otherwise hold funds, financial assets, economic benefits and economic resources for the designated individuals and entities. If so, they must freeze such accounts or funds and, unless licensed by the Treasury, refrain from dealing with said funds or economic resources, and suspend the provision of any financial services. They must also report their findings to the Sanctions Officer at the Customs and Excise Division of the Treasury. Where a relevant institution has already reported details of accounts, other funds or economic resources held frozen for the designated individuals or entities they are not required to report these details again.

Failure to comply with financial sanctions legislation or to seek to circumvent its provisions is a criminal offence.

Annex I to Council Regulation (EC) No 881/2002 has been amended with effect from 17 September 2017, following the publication of Commission Implementing Regulation (EU) No 2017/1571.

This news release is issued in respect of the restrictive measures directed against the Democratic People's Republic of Korea.

Council Regulation (EC) No 329/2007 has been repealed and replaced by Council Regulation (EU) 2017/1509, which has been applied in Island law by the European Union (North Korea Sanctions) Order 2017.

The identifying information for 100 individuals and 54 entities has been amended. One duplicated entry has also been deleted.

Export Control (Amendment) (No. 3) Order 2017 (Application) Order 2017

The Treasury advised that the above Order has been made and comes into operation on 13 July 2017. It makes amendments to existing export control legislation in the Island.

The Export Control (Amendment) (No. 3) Order 2017 (“the applied Order”) which is being applied in Island law with modifications, amends Schedule 2 to the Export Control Order 2008 which contains a list of defence-related items that are subject to export and other controls and which includes items on the European Union Common Military List (“the CML”). The CML is contained in an Annex to Directive 2009/43/EC of the European Parliament and of the Council of 6 May 2009.

The amendments implement changes to the CML made by Commission Directive 2017/433/EU of 7 March 2017. These amendments are largely technical and minor in nature but nevertheless require changes to be made to the Export Control Order 2008.

Annex IV to Council Regulation (EC) No 329/2007 has been amended with effect from 9 June 2017, following the publication of Commission Implementing Regulation (EU) No 2017/993.

Annex I to Council Regulation (EU) No 224/2014 has been amended with effect from 30 May 2017, following the publication of Council Implementing Regulation (EU) No 2017/906.

European Union Sanctions – North Korea

On 23 May 2017, the European Union (North Korea Sanctions) (Amendment) (No. 2) Order 2017 [SD 2017/0186] came into operation, applying in Island law Council Regulation (EU) 2017/658 of 6 April 2017 amending Regulation (EC) No 329/2007 concerning restrictive measures against the Democratic People’s Republic of Korea.

This followed the European Union (North Korea Sanctions) (Amendment) Order 2017 [SD 2017/0161], which applied in Island law Council Regulation (EU) No 2017/330 with effect from 26 April 2017.

As a consequence of the two Orders the following changes have been made:

with effect from 26 April 2017, it is prohibited to open a new bank account held or controlled by a North Korean diplomatic mission, consular post or their North Korean members; and
any bank account held or controlled by a North Korean diplomatic mission, consular post or their North Korean members must be closed;
with effect from 23 May 2017, the existing prohibition on investments in North Korea has been extended to cover conventional arms-related industries, metallurgy and metal-working and aerospace; and
it is prohibited to provide to persons and entities in North Korea computer services and services linked to mining and manufacturing in the chemical, mining and refining industries.

Derogations from the requirement to close existing bank accounts, and the prohibition on opening a new bank account may be authorised by Treasury in certain circumstances.

Other sanctions measures now in place include:

restrictions on transactions in coal, iron and iron ore from North Korea;
a ban on imports of copper, nickel, silver, zinc as well as statues from North Korea;
a ban on export of new helicopters and vessels to North Korea, the tightening of existing restrictions in the transport sector as well as in the financial sector; and
restrictions on the use of real estate property by North Korea in the territory of the EU and the Island.
