Applications in which the Department of Environment, Food & Agriculture is deemed to have an interest - as defined under Article 10(1) of the Town and Country Planning (Development Procedure) (No2) Order 2013, which states;
Any application for planning approval:
- In which the Department is the applicant or agent, or
- Which is for the development of land any interest in which is vested in, or which is occupied by or controlled by the Department
must be referred to and determined by the Council of Ministers.
Whilst any such applications will initially be processed, issued a site notice and published alongside all other planning applications, any representations received by the Department will be directed to the Cabinet Office at the appropriate time where administration and formal consideration will be managed and applied as would be for administering a planning appeal.
Accordingly the Department will, as soon as is practicable after the 21 day notice period for the application has expired, direct all written submissions to the Cabinet Office.
The Department is also invited to provide an assessment of the proposal in planning terms. This will be furnished in the form of a Planning Officer statement in accordance with any timescale set by the Planning Appeals Administrator.
The decision for a Department application will be issued by the Cabinet Office on behalf of the Council of Ministers and copied to all parties who contributed. There is no appeal against these decisions.
