Neighbours to be notified of new planning applications

Residents will receive a written notification when planning permission is sought for a neighbouring property.

The move, which came into effect in January, is part of the Built Environment Reform Programme (BERP), which aims to make planning easier to use and more accessible.

This includes improving engagement, with neighbours notified of a planning application, so they have the opportunity to contribute to the planning process in a timely manner.

Following a planning application, any neighbouring properties directly abutting an application site, with a postal address, will receive a written notification that planning permission is being sought. They will not be sent to field numbers or owners of fields.

The weekly publication of planning applications, as well as the requirement to display site notices at properties where planning permission is being sought, will continue.

A trial major applications process has already been introduced through the BERP to speed up the determination of larger and more complex applications, and a Customer Charter published to set out the standards the Government wants its planning system to achieve.

A survey to gather public opinion on the planning system was also carried out and received more than 110 responses, with people identifying four key areas for improvement.

In response, a number of improvements have already been rolled out, such as, additional guidance for applicants to help avoid costly delays and a review of counter opening times.

Further actions will see a review of staffing, training, and the planning website. The Department will also examine the way planning applications are dealt with, fees and IT systems. These actions will help drive efficiencies and ensure resources are in place to address the 1,400 planning applications received each year in a timely manner.

Clare Barber MHK, Minister for Environment, Food and Agriculture said:

‘This Government has set an ambitious goal to improve the quality of our built environment and build great communities. The survey results are very helpful in understanding what is currently done well and where we can improve. We are confident the resulting actions can make a real difference and help deliver on this programme’s commitment to improve the built environment and build great communities.’

Building great communities is one of five priorities set out in the Island Plan.

Isle of Man Planning Committee seeks new members

People with a strong knowledge of the Isle of Man and an interest in the built environment are being sought to join the Island’s Planning Committee on a five year term.

Whilst the majority of applications are determined through delegation by senior Government planning officers, the Committee is responsible for around 20% each year.

The Planning Committee is made up of six lay members and meets twice a month, in Douglas, to determine around 10 – 20 applications. Its members play an important role as their decisions impact both lives and livelihoods.

Members must be keen to do their best for the Island and capable of understanding policy, whilst acting impartially. They must also be resilient, given the high profile planning has, and confident of dealing with complex and often emotive issues.

No formal qualifications are needed to apply but a good knowledge of Island life and experience in the private, public or third sector are an advantage. Training and ongoing support will be provided to the successful candidates.

Each member is provided with an allowance of £78 per session, plus their travel expenses.

New measures to improve planning system announced

Plans to make the Isle of Man’s planning system more accessible and easier to use have been unveiled as part of an ambitious programme.

The actions are part of the Built Environment Reform Programme, which was launched by the Chief Minister in July, to improve the built environment and build great communities.

It will see the Department of Environment, Food and Agriculture give a trial run to a major applications process to speed up the determination of larger and more complex applications.

This will see people receive more help at the start of the process to minimise costly and time consuming issues further down the line.

Other measures will see a customer charter published to establish a set of standards for the Government to achieve and a survey launched to gather public views on current services.

The feedback from the survey will be used to inform the charter as it develops over time and shape the future of the programme and how planned actions are rolled out.

Clare Barber MHK, Minister for Environment, Food and Agriculture, said:

‘This Government has set an ambitious goal to improve the quality of our built environment and build great communities.

‘The launch of a trial for a major applications process, customer charter and survey are the start of bold action to ensure our built environment is both sustainable and capable of delivering economic and social value.

‘I encourage all those involved in the planning system, the public and our stakeholders to provide feedback as part of the survey, as it will be invaluable in informing our work.’

Programme of reform will help to build great communities for the Island

An ambitious programme of reform to help realise Government’s ambition of building great communities has been launched today by Chief Minister Alfred Cannan MHK.

In a statement to Tynwald the Chief Minister set out a series of actions Government will take in the short to medium term to deliver on its commitment to improve the Island’s built environment and quality of life.

Building great communities is one of five priorities the Government set out in the Island Plan.

The reform programme has four overarching objectives:

Simplify access to the planning system
Improve the planning process
Align national planning policies, plans and strategies with the Island Plan
Ensure attractiveness of brownfield development to help protect the Island's green fields, landscape and beauty

The Chief Minister said:

‘We have set an ambitious goal to improve the quality of our Island’s built environment and to deliver on that promise we need to take bold action. This programme of reform will help deliver a key priority for this Government, ensuring that our built environment is both sustainable and capable of delivering economic and social value.

‘The Programme, published today, acknowledges where we need to focus our efforts. It outlines improvements and innovations we intend to make to the Island’s planning system. These include a trial for a major applications process, a new customer charter, and a publicly accessible performance dashboard.

‘In addition, we are also preparing a brownfield site development grant support scheme, and plans for an Island-wide regeneration strategy.’

The investment in the sustainable development of Government owned brownfield sites through the Manx Development Corporation and through changes to the First Time Buyer's Scheme are two examples of action to extract benefits for the wider community from the Island’s built environment.

The Chief Minister added:

‘Everyone can benefit from transforming unattractive wastelands and derelict buildings into appropriate, affordable, sustainable buildings for residential or modern commercial use. In the process we can attract new businesses and enable existing businesses to grow and thrive.

‘The programme of work will ensure we continue to have an Island community where we are proud to live and proud to call home.’

New planning application for permanent storage facility at Rockmount

The Department of Infrastructure has withdrawn and replaced a planning application to convert a silt store into a permanent storage facility at Rockmount, near Poortown Quarry.

Planning application 20/00837/B was submitted in July 2020 when requests for additional information and changes to the proposed works were received.

Following a period of consultation with the Environment Directorate at the Department of Environment, Food and Agriculture, a new application (22/00287/B) has now been submitted which addresses the points raised and additional information requested.

In line with the 2020 application, the Department is not seeking to deposit any additional dredged material within the facility.

The revised scheme now involves:

re-profiling the outside face of the retaining embankments in order to improve their long-term stability
replacing the temporary cap over the dredged spoil with a permanent long-term cap
installing gas and ground-water boreholes to enable long-term monitoring

The application details the site restoration plan and aftercare, as required under current UK practice for the long-term management of landfill sites, and will allow the site to return to agricultural use.

Waterfall Hotel does not meet building protection criteria

The Waterfall Hotel will not be added to the Isle of Man’s protected building register (PBR).

The building in Glen Maye had been issued a Building Preservation Notice (BPN) in June which temporarily protected it from demolition while further investigations were undertaken.

The investigation by the Department of Environment, Food and Agriculture (DEFA) concluded that the building did not demonstrate the special architectural interest required, either through its rarity or aesthetic merit, or special historical interest representing an important aspect of the Nation’s history.

The 1860s building has been subject to several planning applications with the most recent, which is under appeal, looking to knock it down and replace it with four terraced houses.

Taking the appearance of two traditional cottages, the now vacant building first opened its doors as the New York Hotel in 1865, at a time when the surrounding area was seeing development due to mining at Glen Rushen.

A DEFA spokesperson, said:

'We appreciate that the site will hold sentimental value for some members of the public, and that both residents and visitors will have many fond memories of the hotel and pub.

'However, the building itself has not passed the test for registration as having special architectural or historical interest, so won’t be added to the PBR.'

There are currently more than 275 buildings on the PBR.

Building control launches online application service

People looking to build or extend a property in the Isle of Man will be able to submit their plans to building control digitally from 1 August.

Building control regulates the construction processes involved in building to ensure they are safe and meet current standards for design and construction. These standards ensure the people that use the building are safe and the process addresses things such as access, energy efficiency and health and safety.

Once submitted plans are checked against regulations and if passed the work is inspected during key phases of construction, and if on completion the structure meets the standards, a certificate is issued.

The digital applications can be submitted on the Department of Environment, Food and Agriculture’s website, and after validation and application references are established, application fees can be paid by bank transfer. For anyone who prefers to complete a paper application form they can continue to do so.

Geoffrey Boot MHK, Minister for Environment, Food and Agriculture, said:

‘The move will help make the system even easier to use and forms part of the Government’s commitment to reduce its carbon footprint.’

It is important to note that a building regulations approval is entirely separate from planning permission which decide if the building should be built.
