Applications in which the Department of Environment, Food & Agriculture is the applicant/agent or owns/occupies/controls the application site must be referred to, and determined by, the Council of Ministers.
Whilst any such applications will initially be processed, issued a site notice and published alongside all other planning applications. However, any representations received by the Department will be directed to the Cabinet Office at the appropriate time where administration and formal consideration will be managed and applied as would be for administering a planning appeal. The Department also provides an assessment of the proposal in planning terms.
The decision for a Department application will be issued by the Cabinet Office on behalf of the Council of Ministers and copied to all parties who contributed. There is no appeal against these decisions.
