Together with other Departments of Government, the Department of Education and Children is constituted under the Government Departments Act 1987.

Its main responsibilities and duties are set out in the Isle of Man Education Act 2001. The Education (Miscellaneous Provisions) Acts 2009 contains measures relating to the state education system, school attendance and discipline and other, miscellaneous measures.
