Under the terms of section 24(1) of the Terrorism and Other Crime (Financial Restrictions) Act 2014 (the 2014 Act), where HM Treasury in the UK enacts a measure that is the equivalent of a freezing order or designation made under Division 2 of Part 2 of the 2014 Act, then that measure has effect in the Isle of Man as if it were a freezing order or designation made under the 2014 Act.

Therefore the Treasury requires institutions and businesses in the Island to check whether they hold any funds belonging to the individual freeze any such funds, and refrain from dealing in such funds or making them available to any person (unless permitted to do so under a licence granted by the Treasury).

Anyone finding any funds belonging to the entities must report their findings to the FIU together with any additional information that would facilitate compliance with the requirements of the 2014 Act. Any person with any information concerning any frozen assets must provide the FIU with any information that it may request. Where a relevant institution has already reported details of accounts, other funds or economic resources held frozen for the designated entities they are not required to report these details again.

Part 4 of the 2014 Act contains details of how any person affected by a designation may apply to the High Court to have the decision of the designation set aside.

Financial Sanctions: Ukraine (Sovereignty and Territorial Integrity)

This news release is issued in respect of measures taken against certain persons, entities and bodies in view of the situation in Ukraine.

Annex I to Council Regulation (EU) No 269/2014 has been amended with effect from 14 September 2019, following the publication of Council Implementing Regulation (EU) No 2019/1403.

The identifying information for 19 individuals and 18 entities has been amended. Details of the amendments can be found in the attached Annex.

Financial institutions and other persons are requested to check whether they maintain any accounts or otherwise hold funds or economic resources for, or provide financial services to, the designated individuals and entities. If so, they must freeze such accounts or other funds and, unless licensed by the Treasury, refrain from dealing with said funds or economic resources, and suspend the provision of any financial services. They must also report their findings to the FIU. Where a relevant institution has already reported details of accounts, other funds or economic resources held frozen for the designated individuals and entities they are notrequired to report these details again.

Failure to comply with financial sanctions legislation or to seek to circumvent its provisions is a criminal offence.

Consultation launched on Equality Act 2017 Code of Practice on Employment

The Isle of Man Government has launched a public consultation on the statutory Equality Act 2017 Code of Practice on Employment to gather feedback, which will be considered before the Code is submitted to Tynwald for approval.

The main purpose of the Code is to provide a detailed explanation of the Act, with practical examples of how the Act applies in employment situations. The advice contained in the Code is intended to be best practice for employers, and failure to follow it could be referred to in legal proceedings.

In particular, feedback is welcomed from advocates, advisers, trade union representatives, human resources personnel and others who need to apply the law and understand its technical detail.

The consultation is available on the Government Consultation Hub at www.consult.gov.im and will be live until 7 October 2019. The Code will then be subject to approval by Tynwald and it is planned to be in effect before the year end. This will be the first in a series of codes and guidance scheduled, to support the interpretation and application of the Equality Act, one of the largest pieces of social legislation for the Isle of Man.

Steps in place to secure agriculture and food trade

The Isle of Man Government has contacted all Tynwald Members to seek agreement for an extraordinary sitting of Tynwald to ensure legislation, relating to the sale of animals and animal products between the Isle of Man, the UK and Europe, is in place ahead of the UK’s withdrawal from the EU.

The European Union operates a system where countries, which are not EU Member States, may be granted the status of third country in relation to the products that country is seeking to import into the EU.

Third country listing status allows exports from the Island to the EU to be processed more quickly and subject to a lower level of checks than would otherwise occur, helping such exports to continue after exit day.

As part of the preparations for trading after exit day the Island is, through the UK's Department for Environment, Food and Rural Affairs, seeking to ensure it has third country listing for the products exported from the Island.

A meeting of the EU Standing Committee on Plants, Animals, Food and Feed is due to take place on 11 October at which the Island's third country listing status will be considered. This meeting is prior to the scheduled October sitting of Tynwald. The UK has advised that the Isle of Man legislation needs to have completed the parliamentary process in Tynwald, ahead of this meeting.

Geoffrey Boot MHK, Minister for Environment, Food and Agriculture said:

‘The Department, with the support of the Council of Ministers, is seeking agreement from Tynwald Members to hold an extraordinary sitting on 8 October 2019 to consider a number of items of technical secondary legislation. This early sitting would provide time to assure the UK and EU that the Island's legislation meets the required regulatory standards, ahead of the EU Standing Committee’s meeting to consider third country listing.'

‘Achieving third country listing will ensure that trade in animals and animal products can continue between the Isle of Man, the UK and Europe, after the UK’s withdrawal from the EU.’

Innovation and resilience in local food, farm and fishing businesses awarded

Local food, farming and fishing businesses have been praised for their achievements and increasing diversification at an annual awards ceremony held on Friday 13 September 2019.

The awards were presented by Geoffrey Boot MHK, Minister for Environment, Food and Agriculture (DEFA) in the Manx Cookery Theatre on the eve of the Isle of Man Food and Drink Festival, to each of the five category winners.

The Minister said:

‘Congratulations to all the winners of this year’s awards. Innovation and diversification are key elements to the growth of our local economy. I hope that by seeing how these businesses are achieving success in their communities, others will be given the inspiration and confidence to continue to invest and expand their own businesses.’

The winners at the 2019 Awards were:

Morgan’s Pies Limited (Food category)

In the late 1970s, the Morgan family set up Muffins Bakery in Peel. Today, Lee Morgan sources local meat, potatoes, dairy and flour to make quality, homemade pies and pasties delivered Island wide.

Ballagawne Farm Limited (Farming category)

Brothers David and Robert Cooil farm 550 acres spread around the south of the Island. They own and run Ballagawne Farm where 184 Friesian and New Zealand Friesian cross cows are milked, and Ballacreggan Farm in Port St Mary where calves and young stock are reared.

Isle of Man Seafood Products Limited (Fishing category)

Established in 2007, Isle of Man Seafood Products Limited is the Island’s leading fresh and frozen shellfish processor and distributor. Their main activity is the sale and export of Whelks, King and Queen Scallops, to countries as far afield as Japan and South Korea.

Glen Down Farm (Diversification category)

Located in Port St Mary, the main enterprise of this 8th generation, 350-acre farm is its dairy herd. Its second enterprise is a flock of 270 mule ewes and their lambs, and in 2006 they began to diversify further by converting a disused farm building into a 6 bed holiday cottage. The family has since completed a camp site/camper van park and built their own shepherd’s huts.

Georgie Revill, The Cook Shack (Special Recognition Award)

The Cook Shack is a bespoke cookery school in Bride. Founder Georgie has an infectious enthusiasm for cooking with local produce, especially bread baking using Laxey Flour. She supports many community projects and hosts young carers and team building events with a variety of organisations.

This year’s awards are supported by Shoprite. Award-winners received £250 in Shoprite vouchers, a certificate and an engraved glass trophy.

Finalists also recognised at the ceremony were Paula’s Kitchen (Food category), Ballacricket Farm (Farming category), Nicholas Lewis (Fishing category) and The Dairy Shed (Diversification category). As a runner up, each business received £100 in Shoprite vouchers and a certificate.

Amanda Noble, Marketing Manager of Shoprite, said:

‘It was a pleasure to judge a diverse and broad range of local businesses who are all demonstrating such a high standard in their areas. This year we have a great mix of very deserving winners and I’d like to congratulate them all on their achievement.’

Isle of Man Arts Council awards first annual student bursaries

The Isle of Man Arts Council recently announced the recipients of their first annual student bursaries for 2019/2020. Awarded to students moving into or currently in further or higher education, the three bursaries are each worth £10,000 over the duration of a course.

The Jonathan Gollow Bursary for Performing Arts has been awarded to Saroja Lily Ratnavel, who will be attending The London Academy of Music and Dramatic Art (LAMDA) to study for an MFA in Professional Acting.

Saroja Lily said:

‘I’m so grateful to the Isle of Man Arts Council for all of their support. Getting into LAMDA has been an absolute dream come true as it was my number one school. I’ve always wanted to be an actor so this is a really exciting step for me. I’m really excited to get started this term and get stuck into it.’

The Norman Sayle Bursary for Visual Art and Literature has been awarded to Kipenzi Thomas who will be attending Manchester Metropolitan University to study for a BA (Hons) degree in Fashion and Technology (Menswear).

Kipenzi said:

‘This has been such a great opportunity. I couldn’t have imagined being able to have this much support from a local organisation to help me progress and fulfil my dreams. Before this, I wanted to do Law and I thought to myself, if there was a possibility that I could go into the arts and go full force with my dreams then I’d take it. It means so much that I get this opportunity.’

The Isle of Man Arts Council Bursary has been awarded to Callum Rowe who is studying for a BMus (Hons) degree in Popular Music at the Royal Northern College of Music.

Callum said:

‘I’ve been studying at the Royal Northern College of Music for a year now already and without the Isle of Man Arts Council’s support I wouldn’t be able to continue between living costs, house fees and the fees of the school as well so it means a lot that I can go and do what I love for a University course.’

Marlene Maska MLC, Chairman of the Isle of Man Arts Council, said:

‘We are delighted to make these awards to three extremely talented students and we hope the bursaries will provide a springboard to them furthering their careers in the arts. We received many applications for the new bursaries - all were of an extremely high standard which reflects the depth of talent on the Isle of Man in the Arts, as well as being testament to the high standards of teaching students receive here. We wish Saroja Lily, Kipenzi and Callum the very best of luck with their future studies.’

The Bursaries are named in memory of former Isle of Man Arts Council members, music promoter Jonathan Gollow and artist Norman Sayle, and will be awarded annually.

Public reminded to abide by byelaws to conserve and cherish our natural environment

The public is reminded that it is an offence to ride or drive motor vehicles in the woodlands owned by the Isle of Man Government without permission. Conserving and cherishing our natural environment in forests and plantations has been reinforced by a recent prosecution.

Jamie McCanney from Santon, who is a professional Enduro motorcycle rider, appeared in Court on 12 September 2019 facing prosecution for unlawful use of a motorcycle in Kings Forest in Greeba, which is land owned by the Department of Environment, Food and Agriculture.

The local man pleaded guilty to the offence which occurred on 15 June 2019. The Court, on hearing that the Isle of Man branch of the Auto Cycle Union had already issued Mr McCanney with a six month ban from all local competitions, imposed a six month conditional discharge and fined him £50 court costs.

Geoffrey Boot MHK, Minister for the Department of Environment, Food and Agriculture, said:

‘Active, responsible, recreational use of woodlands, plantations and hill-land is encouraged. Conserving and cherishing our natural environment through byelaws helps to prevent property damage and disturbance to wildlife. This prosecution helps to highlight that it is an offence to ride motorcycles in woodlands or on open hill land without permission.

I would like to thank the Isle of Man Branch of the Auto Cycle Union for their support by recognising the seriousness of the offence and issuing the six month competition ban on the rider.’

The Court heard that a Department Ranger patrolling the forest on 15 June 2019 had come across a group of motorcyclists. Mr McCanney was the only one who stopped to speak to the Ranger and told the officer he had entered the area with the others to practise their motorbike skills. The local rider told the officer that he was not aware that the use of motor vehicles was prohibited in the Forest, particularly as he had trained and taken part in competitions at the Kings Forest previously. It was established that the rider had accessed the woodland via a kissing gate, passing clear signage indicating that vehicles were not permitted.

Culinary flair, ambition and knowledge demonstrated at the Isle of Man Chef of the Year final

Local chefs demonstrated their culinary skills with flair and ambition during the Isle of Man Chef of the Year final held at the Isle of Man Food and Drink Festival on 15 September 2019.

After succeeding at the heats in June 2019, Tyler Livesey from Jean-Pierre’s Bistro in Ramsey and Vladimir Dvorak from Harbour Lights at the Sefton in Douglas competed in the final, captivating the audience with their culinary knowledge and imagination.

Judging for the first time His Excellency the Lieutenant Governor Sir Richard Gozney and Lady Gozney were joined by Geoffrey Boot MHK, Minister for Environment, Food and Agriculture and local chef Tony Quirk.

The accolade was awarded to Tyler who received a trophy and certificate from His Excellency the Lieutenant Governor. The winner will be immersed in a day’s experience working in one of London’s premier restaurants, coordinated by Colby-born chef Colin Clague, the Executive Chef of a prestigious restaurant in the United Arab Emirates – the Ruya Dubai.

In a kitchen specially created for the event by Magnet, Tyler prepared a back saddle of Manx goat with goat’s cheese with interesting accompaniments, whilst Vladimir’s dish celebrated Manx lamb - a fillet of lamb with lamb jus, potato gnocchi and shepherd’s pie foie gras.

Geoffrey Boot MHK, Minister for Environment, Food and Agriculture, said:

‘The Isle of Man Chef of the Year competition, and the Final, celebrate both the extraordinary culinary talent of the Island’s chefs and the superb quality of our Island’s local produce. Congratulations to the finalists.

Not only does eating Manx mean money goes back into the local economy and supports local jobs; it also guarantees a great-tasting meal with fewer food miles.

I’d like to thank sponsors, Robinson’s, for their continued support of the event.’

Tony Quirk, local chef and lecturer at the University College Isle of Man, praised the high standard of the competition and said:

Highlighting the Island’s Biosphere at Isle of Man Food and Drink Festival

The Isle of Man Government’s Food and Drink Festival returns to the Villa Marina Gardens this weekend with a fun-filled programme.

Highlighting the Island’s Biosphere for future generations, the Festival will raise awareness about the Island’s local produce which reduces food miles, packaging and waste, which in turn helps to lower the public’s carbon footprint.

UNESCO Biosphere Isle of Man will be on hand with interactive activities to engage the younger generation, through raising awareness and focusing minds towards achieving the United Nation’s Sustainable Development Goals, and highlighting the global aspect of Biosphere.

The stand will offer information about, and the chance to get involved in, schemes Biosphere is running locally, including Refill Isle of Man, which is reducing single-use plastic use and pollution.

The Green Centre and the Western Civic Amenity Site will provide myth busting facts and information about how to make a difference by recycling and reducing waste.

Beach Buddies will be raising awareness about the impact of single-use plastics on the environment and assisting at the recycling stations across the gardens.

Only reusable cups will be on offer from the Festival Bar, visitors can buy eco-friendly bags from the Manx Produce Marquee for just £3 and bring their own bottles to make use of the new Refill stations.

Free car parking and shuttle bus will be available on Saturday to and from the Bowl Car Park, Douglas to the Festival.

Report published on care and provision at Manannan Court

An independent report is published today (Friday 13 September) into provision at the Island’s acute mental health in-patient facility Manannan Court.

The external review was commissioned by the Department of Health and Social Care in the light of historical concerns about services at Manannan Court’s Harbour Suite, and was conducted by Dr Tommy Dickinson, Independent Psychiatric-Mental Health Nurse Consultant. Dr Dickinson authored a report into acute in-patient facilities in 2015, which were then provided at Grianagh Court.

The terms of the review were to review the policies, practices and procedures operating at the Harbour Suite and to identify recommendations for further action if required. Overall, the report says: ‘The observations and findings during the visit to Manannan Court’s Harbour Suite reveal that many aspects have improved since the move from Grianagh Court. The environment appears much more fit for purpose and the safety of patients is clearly seen as a priority.’

Some of the positive points noted in the report include:

Staff, including those in senior leadership roles, have been internally rotated into different clinical settings, and appear to be flourishing in their new roles. The report describes this as ‘Excellent’
The previous recommendation that ‘any patient requiring Intermittent Observations should only be checked at arbitrary times, but spaced no further than the agreed time interval’ has been implemented. Again this is described as ‘Excellent’
The training and development of staff in how best to care for people with a personality disorder ‘appears to have progressed exceptionally well’
The training and development of staff in how to assess and manage the risk of suicide has made ‘reasonable progress’

The report also identifies some areas where further work is needed. These include:

Patients’ care plans on the ward need urgent improvement. The care plans seen by Dr Dickinson did not appear to be evidence-based or developed in collaboration with the patient
Some staff have been on the same ward for many years; this has been shown to have a detrimental effect and should be addressed by a programme of internal rotation

The ‘Safewards’ approach has been adopted as recommended but more work remains to be done

Other recommendations include the introduction of a ‘robust’ system for obtaining interpreters, ensuring that any interpreter is recognised as such and can guarantee confidentially, and that a clearly visible statement outlining a zero tolerance policy of drugs on the ward should be installed.

Commenting on the report, Interim Chief Executive of Health and Social Care Angela Murray, said:

‘We are very grateful for the dedicated and comprehensive approach Dr Dickinson has taken when compiling this report. It’s pleasing to see that there are areas where we have clearly made huge steps forward in transforming the service. We also appreciate that there is still much more to be done. We will be giving the report very careful consideration and actively looking to implement the recommendations it makes. Overall I am confident that we are moving in the right direction.’

The Minister for Health and Social Care, David Ashford MHK, added:

‘I would also like to thank Dr Dickinson for this excellent report. We know that we can always improve, and this report will be instrumental in directing where our efforts need to be focussed in future. Not forgetting that we have come a very long way since we were made aware of concerns at Manannan Court, with the report highlighting those areas where we are already making very substantial progress.’

Teachers recruited for new academic year

A significant number of teachers have been appointed to our Island’s schools at the start of the 2019 academic year, to inspire, engage and nurture young people to achieve their potential.

A summer recruitment campaign proved successful in attracting a wide variety of applicants from those with experience to those who are newly qualified. Thirty-three teachers have taken up their new posts in primary schools across the Island, with secondary schools welcoming 37 recruits across all subjects.

Of these positions, more than 25 will be working with the Department of Education, Sport and Culture for the first time and 10 have been specifically recruited to teach mathematics and science, subjects that are traditionally more challenging to attract.

As part of this year’s campaign, the Department worked with Locate Isle of Man to produce an article about teaching in the Isle of Man which was published in TES, a UK education business which publishes a weekly magazine. This generated a number of enquiries and as a direct result of the article two teachers have relocated to the Island to begin their new roles in our secondary schools.

Oncology Unit opening marks new era of patient care

A brand new, state-of-the-art day facility for oncology patients in the Island will be declared officially open at a ceremony at Noble’s Hospital this weekend.

The Eric and Marion Scott Oncology Unit serves patients who come to hospital for cancer therapy treatment and those attending specialist consultant clinics.

Based in the former Noble’s Ward 5, the conversion, refurbishment and equipping of the unit has been funded entirely through charitable donations from the Eric and Marion Scott Trust and the Noble’s Hospital Equipment Trust. The refurbishment was completed within a challenging time frame by construction partners SCS who began the project in January; the first patients were welcomed into the unit in July this year.

The unit will be officially opened on Saturday 14 September 2019 by the Minister for Health and Social Care David Ashford. After the ceremony, guests will be invited to look around the unit and meet staff, and there’s an opportunity for members of the public to see the new improved facilities from 3pm.

Media are invited to send a reporter/photographer to the opening on Saturday at 2pm.

The bespoke modern facility replaces a stand-alone unit on the Noble’s estate which was separate from the main hospital building. It provides almost double the number of treatment stations for day patients than before, including four specially adapted chairs for haemato-oncology patients, those being treated for blood cancers. A dedicated car park and direct entrance to the unit are integral to the design, to ensure patients receiving treatment for cancer can come and go swiftly and discreetly.

Those attending oncology clinic appointments will still use the main Noble’s entrance and once in the unit will be shown straight into the clinic area where they’ll find a comfortable waiting room and two purpose-built oncology consultancy suites.

Décor, colour schemes and artwork within the unit have been carefully selected to provide an appropriate calming atmosphere, and more artwork will be going on display over the coming weeks, including images donated by local artists, photographic societies and patients.

Minister Ashford said:

‘I’m delighted and honoured to perform the official opening of this superb new facility, which will greatly enhance the experience of Island patients. The vision we shared with the Eric and Marion Scott Trust to bring together oncology services at Noble’s under one roof has now been realised, and we thank the Trust and donors for their generosity. The new unit has been designed with the needs and sensitivities of patients very much in mind and a number of features have been incorporated in response to their suggestions. We can be very proud of what has been created.

He added:

Householder awareness: cold calling is illegal

The Isle of Man Office of Fair Trading is advising householders not to employ traders who make unsolicited visits to their homes offering to do home improvements, as cold calling is illegal on the Island.

Householders approached by unscrupulous traders, who cold-call, are often persuaded to accept their offer because they initially appear to be cheaper than genuine traders and can begin work straightaway.

These types of traders can be very persistent, pestering householders into having unnecessary work done and have even been known to take their victims to the bank to secure payment. They may offer special deals, do not readily take no for an answer and may carry out poor quality work using sub-standard materials.

John Peet, Head of Isle of Man Office of Fair Trading, offers these tips to the public to avoid becoming the victim a cold-calling trader:

Do not deal with traders who call at your house without an appointment offering to do work
Do not be pressurised into having unnecessary work done.
Do not fall for comments such as 'we’ve got some tarmac left over from a big job'
Do not part with a significant amount of cash up front
Do call the Trading Standards Division on 686520 or the police, if you feel you have been approached by a cold-calling trader

Friends, neighbours and relatives of the elderly and vulnerable should make them aware of the advice, that cold-calling is illegal.
