The Civil Service Act, 1990, describes a Civil Servant as an "Officer of the Crown and a public servant". This is someone who is employed in a civil capacity and whose salary is paid out of money provided by Tynwald. The present unified Civil Service was created in 1962, and replaced a system in which individual Boards of Tynwald directly engaged and employed their own staff.

In accordance with the current legislation (Civil Service Act 1990), all civil servants are appointed by the Civil Service Commission. Civil Servants can be part-time, full-time or on a fixed term appointment and they serve the public by carrying out duties that are wholly or mainly administrative, professional, technical or clerical in nature. Therefore, manual workers are not part of the Civil Service, neither are certain other staff such as Police Officers, Teachers, Firemen, Nurses and members of the Judiciary.
