| Does the Isle of Man Data Protection Act comply with the EU directive ? | The Data Protection Act 2002 has been drafted to meet the standards set out in the European Data Protection Directive 95/46/EC and is similar to the UK's Data Protection Act 1998. On the 28th April 2004, the European Commission formally recognised that the Island's data protection legislation provides an adequate level of protection. |

| Is the Isle of Man Act the same as that in the UK ? | The Data Protection Act 2002 is very similar to the UK’s Data Protection Act 1998. There are three main differences:

| If my company is registered in the UK will our offices in the IOM be covered by our UK registration ? | No, the Isle of Man is not part of the UK and therefore your UK registration does not cover your IOM offices. |
| I use a diary and address book on my home PC to send letters and e-mail friends do I have to notify the Supervisor? | No. Personal data processed for an individual’s personal, family or household affairs are exempt. |
| How much does it cost to notify? | The cost of notification is £40 per annum. Registered Charities, and “not for profit” organisations, such as sports clubs, are exempt from fees. |
| Can you access the information held about me by a credit reference company or my bank ? | No. The Supervisor cannot access information on your behalf, but, we can advise you how to get access to your information. |
| How much does it cost to get advice or have a consultation with the Supervisor ? | The Supervisor does not charge for advice. |
| Can I get a copy of the Data Protection Act 2002 ? | Yes. You can access a copy of the Act from the legislation page of the website. There is a nominal fee for persons wishing a hardcopy of the Act. Hardcopies of the Act are also available from the Tynwald library. |
| Who does the Data Protection Act protect ? | The Act is there to protect you and your right to privacy. |
| What Rights do I have as a person whose information is held by someone else? | Please see the section entitled Your Rights on this website. |
| I live outside the Isle of Man but a company on the Island holds information on me for my investments etc. Am I protected under the Isle of Man Act ? | Yes. If a company in the Isle of Man processes your personal data then your data is protected under the Act regardless of your nationality or residence. You also have the same rights of access to your personal data as an Isle of Man resident. |
| I keep receiving junk mail and telephone sales calls. Can data protection stop them ? | Under the Data Protection Act 2002, you have the right to object to direct marketing. Please refer to the direct marketing advice in the Your Rights section of this website. If you reside in the British Islands and wish to prevent unsolictited direct marketing, the following UK agencies keep a register of persons who have indicated they do not wish to receive sales and marketing material. | I have been turned down for credit and can't find out why. What can I do? | Please refer to the credit reference problems advice note which can be found in the Your Rights section of this website. |
| How do I know if a company is registered under Data Protection? | The Supervisor maintains a register of data controllers. A regularly updated list of the names of data controllers is available on our website, but this does not contain the details of the register entry. The full register is publicly available at our office, and whilst there is no charge for access to the register, a nominal fee is charged if you wish a hardcopy of a register entry. |
| How do I know what a company is registered for ? | Each register entry shows details about the data controller; the information it holds, the purposes for which it is used, to whom (recipients) it may be disclosed and countries to which it may be transferred. |
| What kinds of information may I access and how do I get access? | Please refer to the right of access to personal data advice in the Your Rights section of this website. |
| Can I get access to Police records? | Yes. You can make a subject access request to the Police. Please refer to the right of access to personal data advice in the Your Rights section of this website. The Isle of Man Constabulary have an application form available. This can be found on the Isle of Man Constabulary Vetting and Disclosure Unit webpage. This is often done where people are emigrating and need to produce proof of that they have no criminal record. However, some information may be withheld if it is exempt from disclosure. |
| What information is exempt from disclosure? | Under certain circumstances information does not have to be made available. These include circumstances where disclosure would identify a third party who has not given consent to the disclosure, for the prevention or detection of crime or where the information may cause damage or harm to the individual concerned. |
| The newspapers have published the details of my house purchase/divorce without my permission. Can they do this? | Yes. This information is contained in public registers. As this information is required to be made available to the public by law the press can obtain and publish this information. |
| What is 'Personal Data'? | This means data consisting of information about a living individual who can be identified from that information (or from that information and other information in the data controller’s possession). In practical terms this means such information as name, address, telephone number, education, profession, financial details, qualifications etc. Please see our advice note "Is it personal data?" for more comprehensive guidance. |
| Who is a data controller? | A data controller is an organisation or individual who, either alone or jointly in common with others, determines the purposes for which personal data are to be processed. |
| Once you have notified is that it? | No. Notification is just part of your responsibilities and obligations. All data controllers are required to comply with the Act and the eight data protection principles. Please refer to the business advice section for further information. |
| Is it an offence not to have notified ? | Unless an exemption from notification applies, it is an offence to process personal data without notification. Please refer to the How to Notify section for further information. The Court can impose a fine of up to £5000 for non-compliance with the law. |
| Is there Freedom of information legislation in the Isle of Man? | No - but there is a "Code of Practice on Access to Government Information", although the Supervisor is not responsible for the administration of this Code of Practice.
