Legislation

The Isle of Man has adopted health and safety legislation that differs from that in use in the UK. Whilst there is a great deal of similarity in the primary Act, The Health and Safety at Work etc Act 1974 as applied to the Island by Order, many of the regulations have been drafted locally. Others are amended versions of legislation that applies in the UK.

Unadopted UK legislation is best viewed as an illustration of good practice. UK legislation and guidance may be helpful in explaining the general duties imposed by the 1974 Act.

The list below identifies the legislation currently in force on the Island. This includes The Construction (Design and Management) Regulations 2003(CDM Regs) and The Management of Health and Safety at Work Regulations 2003, both of which were approved at the January 2004 sitting of Tynwald. These 2 sets of Regulations are also available to view or download from the table at the bottom of this page. Risk Assessments in the Workplace

The Management of Health and Safety at Work Regulations 2003 come into force on 1 October 2004, and will require all employers to make an assessment of the health and safety issues in their work. The Health and Safety at Work Inspectorate has produced 3 new guidance documents to help employers understand how to assess risk in their workplaces. Copies of these documents are available to view or download at the bottom of this page. Fire Risk Management in the Workplace

Under Regulation 17 of the Management of Health and Safety at Work Regulations 2003, certain new responsibilities are placed on employers regarding fire precautions. The essential part of the Regulation is that employers make an assessment of the fire risk as it exists in their premises, and plan to manage that risk.

On the 18th and 19th March 2004, the Health and Safety at Work Inspectorate invited the Fire Protection Association to present their highly regarded training sessions on "Fire Risk Asessment in the Workplace". A total of 167 delegates attended 4 training sessions over the 2 days. Slides of the presentation are available to view or download from the table at the bottom of this page. The table also includes a document, which provides details of the process involved in making a fire risk assessment.
