NHS ACT 2001

The provision of the National Health Service on the Island is set out in the NHS Act 2001. A copy of which is available from the Government Information Centre

Section 1 of the NHS Act 2001 places a duty on the Department to provide a National Health Service -

1. Duty of Department

  1. The Department of Health and Social Security ("the Department") shall —
    1. continue to promote in the Island a comprehensive health services designed to secure improvement in —
      1. the physical and mental health of the people of the Island, and
      2. the prevention, diagnosis and treatment of illness, and
    2. for that purpose provide or secure in the Island or elsewhere the effective provision of services in accordance with the following provisions of this Act.
  2. Subject to any other provision of this Act, and to any provision made by regulations, the services provided under this Act shall be free of charge.

As part of the requirements of the NHS Act 2001, the Department has set up a number of related Committees –

The NHS Act 2001 also provides powers for the Department to introduce legislation modifying the regulation of healthcare professionals. Further information can be obtained on the Health Professions page.

National Health Services (Expenses in Attending Hospitals) Regulations 2004.

These Regulations provide for a scheme whereby the Department can pay in certain circumstances the travel expenses and an accommodation allowance to persons referred by the Department for NHS treatment in the United Kingdom. (See downloadable document at bottom of page).

National Health Service (Appointment of Consultants) Regulations 2003.

These Regulations establish the procedure by which the Department can appoint consultant medical practitioners. (See downloadable document at bottom of page).

National Health Service (Complaints) Regulations 2004.

These Regulations establish a Complaints Procedure for the National Health Service. (See downloadable document at bottom of page).
