Staff of Government (Appeal Division)

The Staff of Government Division of the High Court of Justice of the Isle of Man is the Isle of Man's Court of Appeal. All cases heard in this court have already been heard, and have had judgment delivered on in a lower court. If any of the parties are unhappy with the outcome of their cases in the lower court, they may be entitled to start an appeal, or seek leave to appeal from the Staff of Government Division.

The Staff of Government (Appeal Division) can hear appeals from the Civil Division as well as criminal appeals from the Court of General Gaol Delivery and the Courts of Summary Jurisdiction.

Composition

The Staff of Government (Appeal Division) consists of at least two judges of the High Court of Justice of the Isle of Man. This may be His Honour the First Deemster and the Judge of Appeal. This composition, however, is flexible depending upon which judge has sat in the lower court on the matter to be appealed in the respective lower court.

There are also certain instances in which a single judge may sit in the Staff of Government (Appeal Division).

Privy Council

Judgments and orders of the Staff of Government (Appeal Division) may be appealed to Her Majesty in Council with either the leave of the Staff of Government (Appeal Division) or the special leave of Her Majesty in Council.
